AS Law LA1 feedback 2012 Chief Examiner Professor Iwan Davies
2
June Series Question One - Juries This was the most popular question, overall part (a) was well done. Candidates struggled with the specific nature of the question in part (b) with some still applying the old law pre-CJA 2003.
3
June Series Question Two - Rule of Law and HRA Popular question which was generally well-answered. In (a) some candidates failed to consider Dicey. In (b) answers were improved on previous years with most candidates able to identify sections 2, 3 & 4. Although there could be a lack of case law.
4
June Series Question Three – Civil court structure and equitable remedies Part (a) was poorly answered with come confusion between the criminal and civil courts. Part (b) produced a mix standard of answers with some candidates just summarising the development of equity.
5
June Series Question Four – Access to justice This was not a popular question. In (a) CDS was explained well although the PDS was often not mentioned. I In (b) the better answers discussed the current political climate, the Carter reforms and current opinions.
6
June Series Question Five – European Union Candidates were more confident with (a) when explaining the ECJ. In (b) candidates tended to describe all the institutions rather than discuss the role of the Commission.
7
June Series Question Six – Civil Justice System Part (a) caused candidates problems. It was apparent that they were not as comfortable with the problems with the Civil Justice System as they were with the reforms.
8
Structuring Answers Some weaknesses in the organisation and planning of answers –Candidates must have a clear understanding of the assessment objectives. –They need to have a clear understanding of what the question/ statement demands
