4 What are biobased products? Commercial or industrial products (other than food or feed) that are composed in whole, or in significant part, of biological products, renewable agricultural materials (including plant, animal, and marine materials), or forestry materials.

5 What are biobased products? Biobased products are made from renewable agricultural materials Biobased products often replace petroleum-based products in many areas including automobiles, construction materials, cleaning chemicals, and clothing.

6 What are biobased products? Many biobased products are being made for the function and comfort in the interior of businesses and homes – carpet backing, – padding for furniture, – printing ink, – insulating foams, – molded appliance cases for refrigerators and freezers.

7 What is BioPreferred SM ? BioPreferred SM is the name of the procurement preference program designed to increase the purchase and use of biobased products by Federal agencies. The 2002 Farm Bill charges the United States Department of Agriculture (USDA) with managing the BioPreferred SM Program.

8 What is BioPreferred SM ? USDA is tasked with designating groupings of biobased products that require a BioPreferred SM federal procurement preference.

9 Why Purchase BioPreferred? The BioPreferred Program aims to increase the purchase and use of renewable, environmentally friendly biobased products while providing green jobs and new markets for farmers, manufacturers, and vendors.

10 Why Purchase BioPreferred? The BioPreferred program offers three major benefits: – Climate Change Impact Reduction; – Energy/Environmental Security; and – Economic Development.

11 Climate Change Impact Reduction Qualifying biobased products reduce the introduction of new fossil carbon into the atmosphere.

12 Economic Development Biobased products create jobs by increasing demand for agricultural and forestry materials and by increasing new product development, manufacturing and ultimately sales.

13 Energy/Environmental Security Biobased products replace petroleum products helping to increase U.S. energy and environmental security and independence. Many biobased products are sustainable, renewable and compostable.

14 Why Purchase Biobased Products? The purchase of BioPreferred products by federal agencies is required by law and Executive Orders

15 Legislative Basis of BioPreferred Program Section 9002 of Farm Security and Rural Investment Act of 2002 (2002 Farm Bill) require each Federal agency to establish an affirmative procurement program for qualifying BioPreferred products

16 Food Conservation and Energy Act of 2008 (2008 Farm Bill) For biobased products: – Establishes process for determining eligibility criteria for intermediate ingredients and feedstocks for Federal agency procurement. – Permits labeling of intermediate ingredients, feedstocks, and complex products

17 Executive Orders 13423 and 13514 Requires Agencies in acquisitions of goods and services, to use sustainable environmental practices, including purchase preference for biobased products.

18 Executive Order 13514 Signed by President October 2009 Requires that 95% of all new contracts, including contract modifications, for products and services specify biobased products.

19 Federal Acquisition Regulation Final rule published 11/7/2007: – Part 23: Agencies must consider biobased products in acquisition planning and solicitations – Part 52: Agencies must include biobased in new solicitation provisions and contract clauses

20 BioPreferred SM Designation Process The federal procurement preference process begins with the designation by USDA of groups of biobased products that meet specified criteria.

21 BioPreferred SM Designation USDA initiates the designation process by gathering product data to determine biobased content, technical characteristics, public health, and environmental data for a grouping of products.

22 BioPreferred SM Designation Process The BioPreferred designation process information is reviewed and presented through the Federal Register for public comment before final designation is made.

23 BioPreferred SM Designation Process Once a product grouping has been designated, any commercially available product that meets the minimum biobased content standards within that grouping becomes eligible for procurement preference by the Federal Government.

24 BioPreferred Product Examples Examples of designated BioPreferred SM items include; floor coverings paints and coatings cutlery cleaners lubricants
