JACK O’CONNELL State Superintendent of Public Instruction 3 CAHSEE Requirement All students must satisfy the CAHSEE requirement, as well as all other state and local requirements, in order to receive a California public high school diploma. The CAHSEE requirement can be satisfied by passing the exam or, for students with disabilities, receiving a local waiver pursuant to Education Code Section 60851(c), or receiving an exemption pursuant to Education Code Section 60852.3 (2006) or 60852.4 (2007).

JACK O’CONNELL State Superintendent of Public Instruction 4 Recent Regulations Changes Adult students may now take the CAHSEE up to three times per school year and may test in successive administrations. By July 1, 2006, LEAs must submit to CDE data regarding the exemptions granted pursuant to Education Code Section 60852.3. By July 31 of each year, LEAs must report to CDE data regarding the local waivers granted pursuant to Education Code Section 60851(c).

JACK O’CONNELL State Superintendent of Public Instruction 5 Excessive Orders Number of test administrations versus opportunities to test While there is currently no consequence to districts for overordering, CDE is considering regulations to reduce excessive ordering. When there is a need to place an order prior to receiving test results from the previous administration, estimate based on previous pass rates. Do not order for all students who participated in the previous administration.

JACK O’CONNELL State Superintendent of Public Instruction 6 Student Results Retention Requirements Districts must maintain in each student’s permanent record the following information: –The date(s) the student took the CAHSEE. –Whether the student satisfied the CAHSEE requirement for each section of the exam. Must be entered in the student’s permanent record within 60 days of receiving data files from test contractor.

JACK O’CONNELL State Superintendent of Public Instruction 7 Test Variations The CAHSEE Regulations identify: –Variations for all students –Variations for English learners –Accommodations for students with disabilities students –Modifications for students with disabilities Unlisted Variations

JACK O’CONNELL State Superintendent of Public Instruction 8 Test Variations (continued) English learners must be provided with certain test variations if regularly provided in the classroom or used for assessment. Students with disabilities must be allowed to take the CAHSEE with any accommodations or modifications specified in their IEP or Section 504 Plan.

JACK O’CONNELL State Superintendent of Public Instruction 9 Local Waiver Process Education Code Section 60851(c) explains the waiver process in detail. At the request of the student’s parent or guardian, a school principal must submit to the local school board a request for a waiver of the requirement to pass the part(s) of the CAHSEE on which a modification was used and the equivalent of a passing score was earned.

JACK O’CONNELL State Superintendent of Public Instruction 10 Local Waiver Process (Continued) For the local board to waive the CAHSEE requirement, the principal must certify the pupil has: (1) An IEP or Section 504 Plan that requires the modifications to be provided to the pupil when taking the CAHSEE. (2) Completion, or in the process of completion, of high school-level coursework sufficient to have attained the skills and knowledge otherwise needed to pass the CAHSEE. (3) A score report showing that the student received the equivalent of a passing score on the CAHSEE while using a modification.

JACK O’CONNELL State Superintendent of Public Instruction 11 Exemption for 2007 – Senate Bill 267 Exemption for certain students with disabilities in Class of 2007 (Education Code 60852.4) who meet all other graduation requirements except CAHSEE Requires data collection - number granted diplomas with this exemption By June 1, 2007 requires the Superintendent of Public Instruction with approval of the State Board of Education to recommend a course of action to the Legislature

JACK O’CONNELL State Superintendent of Public Instruction 12 Exemption for 2007 – (continued) Eligibility Verification Forms should be used to document student eligibility for this exemption. CDE will make these available in January 2007. This law is in effect through December 31, 2007.
