PROBATE CLOSING PROCESS Presented by Roberta Larvingo

Appeal Period (First 45 days) Probate order is issued by Administrative Law Judge BIA Probate staff reviews the probate order. Establishes new TAAMS accounts and scans probate order into ProTrac OST Information is reviewed. Tribal enrollment information is reviewed Review certified inventory

What can be done during the appeal period? Family or interested party are given time to appeal the judge’s decision. Any corrections to the order can be submitted to the Office Hearings and Appeals by BIA Probate. Updates to certified inventory can be submitted.

Distribution Process Land Assets Distribution/Verification 45 appeal period has ended. BIA Probate staff reviews order and compares certified inventory with decedent’s ownership in TAAMS. If different petition for reopening to add or deleted inherited trust land interests is completed and submitted to OHA. Once review is completed and there is no changes the probate case is transferred to Land Titles and Records Office.

Distribution Process (Con’t) IIM Account Distribution/Closure Land assets are distributed in TAAMS. BIA Probate reviews TAAMS ownership for decedent to verify all land assets were distributed. IIM account information is reviewed. Date of Death balance is verified. Tracts are identified for deposits. Addresses for heirs are verified. OST Transmittal is completed. Case is transferred to OST for IIM account distribution and closure.

Ending of Probate Case BIA reviews decedent’s TFAS account and TAAMS account. Verify decedent’s IIM account is closed. Verify decedent’s TFAS account does not have any ownership. Case is ENDed in ProTrac.
