The Trade Practices Act (Cth) 1974 and similar State and Territory legislation in Australia may confer rights and remedies on the Client in relation to the provision by Outdoor Inspection Services of the Reports and Services which cannot be excluded, restricted or modified. Outdoor Inspection Services does not exclude any non-excludable rights but does exclude all other warranties implied by custom, law or statute. Under no circumstances (including but not limited to any act or omission on the part of Outdoor Inspection Services ) shall Outdoor Inspection Services be liable for any indirect, incidental, special and/or consequential loss whatsoever which result from any use or access to the Reports or their content, and the performance by Outdoor Inspection Services of the Services. The Client expressly acknowledges and agrees that Outdoor Inspection Services may appoint subcontractors for the purpose of providing the Services and compiling of the Reports and is not liable either for their opinions, comments or their behaviour including any inaccurate information, statements or conduct. To the fullest extent permitted by law, Outdoor Inspection Services liability for breach of any implied warranties which cannot be excluded is limited at the option of Outdoor Inspection Services to the resupply of the Services or the payment of the cost of having Services supplied again. Outdoor Inspection Services refers the Client to clauses 5 and 10 in the Outdoor Inspection Services Standard Terms and Conditions, which relate to confidentiality, copyright and protection and general indemnity conditions.
