13Conclusions Public meetings / Sep-Oct 2011 Maintain the same overall benefits and follow the evolution with the addition of new benefits while at the same time trying to constrain the cost increase. This is not an easy task and everybody’s help is needed to win the challenge and keep our very good health insurance system alive and maintainable in the long run. Thank you for your attention.

22 STOP Harassment – Investigation process Public meetings / Sep-Oct 2011 Initial phase.Lodge the complaint (the alleged victim can be assisted...)..The Chairperson appoints an Investigation Subpanel to decide whether the complaint is receivable..Written decision within 30 (maxi. 60) calendar days. (can be challenged by the alleged victim). Investigation phase. The complaint is receivable, the investigation process is launched. It should normally not last more than 195 calendar days..The alleged harasser receives the statement of the alleged victim. Within 30 calendar days, he/she should provide his/her statement and can be assisted..At the end of the process, an investigation report is provided to the Chairperson who sends the report to the DG with his/her opinion (copy to the Head of HR). Decision of the Director-General and action (where appropriate). Within 30 calendar days, the DG decides whether harassment has occurred and, if yes, takes further decisions (disciplinary or administrative action)..The alleged victim and harasser are notified in written by the Director-General. The notification includes facts established and opinions set out. The decision can be challenged either by the alleged victim or harasser.

23 STOP Harassment – role Staff Association Public meetings / Sep-Oct 2011 One of the main tasks of the CaPa commission is to provide advice, assistance and support to any person facing harassment, in confidentiality and without any judgment. Almost all changes proposed by the Staff association related to the CA 32 and the EOAP were introduced in the OC 9 and the HIP. Main changes: addition of the “abuse of authority/power” in the definition of harassments possibility of being assisted by a member of the personnel at all stages of a process definition of precise deadlines at all stages of the formal process written notification of decisions, at all stages of the formal process, with reasons, facts... possibility to challenge decisions (internal procedure and/or TAOIT). Although the prevention aspect was not treated in the OC 9, the SA was involved by the Ombuds in the edition of two guides (Manager guide and Complainant guide). To conclude and as mentioned by the Ombuds in his presentations: “Harassment will leave wounds and traces on people for a long-time and it endangers the image of the Organization in the public, Member States and Non Member States!”.
