Patent Policy Update Conducted two special telecons Minutes of first telecon are approved, second telecon minutes will be set up on poll later today We have completed resolutions and issued actions We have adopted Patent Policy text by CMC poll Applies to both existing Procedures Manual and new draft Discussion of Provision by CNES CCSDS Management Council may make a standardization decision based on priorities and needs of the larger community of [CMC CCSDS] agencies and ISO member bodies Insures broader inclusion of Observer agencies, etc. Discussion of Provision by NASA Add: CCSDS documents that have known patent issues will not be approved for publication until an ISO Patent Statement and Licensing Declaration Form is signed by the Patent Holder indicating RAND terms for patent licensing. (or pre-existing in the ISO Patent Database). Clarification of *both* early and late requirements, per resolutions 2

Patent Policy Update Clarification of what is required and when: Chartering a WG: Only require statement of expected patent issues, if any Approving addition of a document to the program of work: For any known patent issues, we require the ISO Declaration form before approval Approving a document for publication: For any known patent issues, we require the ISO Declaration form before approval Observation: Some WGs don’t understand the ISO database If a patent is already in the ISO database, they simply have to state that. Some patents in the ISO database reference a technology (MPEG) but not a specific patent. Generally this should be OK, but it should be reviewed by the CESG to confirm. Some WGs’ may call out the use of commercially available HW The manufacturers pay the license fees, not the users In this case, we should not require the ISO form. Perhaps this needs clarification in a later update of the procedures text 3
