2 “Indiana University does not tolerate sexual harassment of its faculty, staff, or students.” Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when: submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment or academic advancement; submission to or rejection of such conduct by an individual is used as the basis for employment or academic decisions affecting such individual; or such conduct has the purpose or effect of unreasonably interfering with an individual's work or academic performance or creating an intimidating, hostile, or offensive working or learning environment. 3 Sexual Violence Sexual Violence: a form of sexual harassment that includes rape, sexual assault, sexual coercion, domestic violence, dating violence, stalking, or any sexual actions that violate another's personal boundaries Sexual assault is both a civil offense and a criminal offense IU Prohibits Sexual Violence INDIANA UNIVERSITY 3

4 Regulatory Framework Title IX of the Educational Amendments of 1972 Prohibits discrimination on the basis of sex in education programs and services Sexual violence is a type of sex discrimination Clery Act requires institutions to: Collect and publish campus crime statistics, and publish numerous policy statements in an Annual Security Report Adopt emergency notification, response and testing procedures, and provide timely warnings to the community as appropriate Violence Against Women Reauthorizaton Act (VAWA) requires colleges and universities to: Report domestic violence, dating violence, and stalking, in addition to those crime categories already mandated by the Clery Act. Adopt certain student discipline procedures, such as first notifying purported victims of their rights. Adopt certain institutional policies to address and prevent campus sexual violence, such as to train in particular respects pertinent institutional personnel. INDIANA UNIVERSITY 4

6 Do not promise confidentiality –Direct anyone seeking anonymity to a “Confidential Employee” identified on campus Counseling and Psychological Services (including Sexual Assault Crisis Services) Student Advocates Office IU Employee Assistance Program (AI’s and full- time employees) INDIANA UNIVERSITY Your Role as a Responsible Employee
