One provision is that a defendant is not required to testify against him/herself. 6 th Amendment: Guarantees “a speedy and public trial.” 8 th : No cruel or unusual punishment.

An accused person may choose to be tried by a judge rather than a jury.

4 10/18/2015 copyright 2006 www.brainybetty.com ALL RIGHTS RESERVED. 4 Rules Whether judge or jury is chosen, the law states that in a criminal trial, a person is presumed innocent until proven guilty “beyond a reasonable doubt.” Without sufficient proof, the judge or jury must acquit, or find not guilty, the person who is accused.

Prosecution: in a criminal case, the side that brings the case against a person accused of committing a crime.

Cross-examination: the questioning of a witness in court. Hung jury: when a jury cannot reach a unanimous opinion or clear majority on a case. The case will be tried again with a new jury.

Technicality: In a court case, a small loophole in the legal system (e.g. evidence obtained without a search warrant) that causes the trial to be stopped and the defendant to be set free.
