Chile and Budapest Treaty Budapest Treaty on the International Recognition of the Microorganisms Deposit for the Patent Procedure Purposes comes into force in Chile in 05/08/2011. The treaty regulates the disclosure of contents of patent applications regarding microorganisms through its deposits and its main objective is avoiding the filing of deposits in each of the countries where the applicants want to apply for a patent. In 2012, Chile was designated International Authority for the Deposit of Microorganisms (IDA) for the WIPO. The Agricultural Research Institute (INIA) through its Chilean Microbial Genetic Resources Collection (CChRGM) becomes the first and only IDA in South America. Nowadays, Budapest Treaty has 79 members states and 42 IDAs 5

Conclusions For Chile the use of international treaties such as PCT and Budapest are tools to be part of the international patent system. These treaties promote patenting both at national and regional levels, providing easier means and more alternatives for the applicants to protect their inventions. Once INAPI starts its operation as PCT ISA/IPEA, a more active role in the international patent system and collaboration with other offices in his development is expected. 6
