2 Civil Courts and the track system There are three Civil courts used for the trial of a case, Small claims court, County Court and the High court. The County court is responsible for handling all the paperwork of the case until the exact amount of the claim for damages is known. Then the case is given to one of the three courts. Money Claim online.Money Claim online The track system is the name given to the three ways a contract claim can progress through the courts as follows: 1.Small claims track: Any claim for damages upto £5000. The trials take place in the small claims court. 2.Fast track: Any claim for damages between £5000 to £25000. The trial takes place in the County court. 3.Multi track: Any claim for damages of £25000 and over. The trial takes place in the High court.

3 Tasks in groups of three: 1.Using your notes on pretrial procedures create a revision tool to revise the process by which a Claimant starts a claim for damages. 2.Create either a spider diagram, a bullet point list or a flow chart to show this process. 3.Go onto the court website and print out a claim form N1 and fill it in for the Claimant in June 2010 exam paper on Contract.court website 4.Complete the table for each exam paper stating which track and court the contract claim would be tried in. 5.Complete this exam question. Jan 2010: Identify which court would hear the claim and outline the procedure that would be followed from issue of proceedings up to trial. (5 marks)
