5 Issues Based Expert Groups STEERING BOARD Market sector representation ~ Debating Policy ~ Escalation of Issues ~ Agreement on when formal Consultation is required Vehicle for Senior BT 21CN Programme personnel & Ofcom to Consult with Industry representatives Review strategy recommendations made by Portfolio Group ~ Review DSP and recommend actions I & M Provide Operational support and Learning to allow CPs to migrate (to include the opening and closing of exchanges) Make sure CPs understand the Operational processes associated with migration COMMS PORTFOLIO Set up Expert Groups and define tasks to be completed Ensure linkage between products, review portfolio decisions/implications to date, eg MSIL; proactive and reactive portfolio management Progress, deliverables & issues from Experts Groups (frees up Steering Board) Roadmap responsibility – individual products & cross portfolio Responsibility for ensuring DSP related tasks are discharged Audience - Product Experts with the ability to think in a company wide way & filter info back into their company, max of 2 representatives from each CP CONTRACT (MSA) SYSTEMS [NICC B2B] Standing Meetings The structure allowed the Point to Point, Line Access, I&P, Network Structures, and Broadband WGs to close. 8 8 Broadband WBC - Working towards planned footprint 40% by April 09 -WBMC - managed variant for WBC end users Datastream retirement – confirmed framework in place and communicated to CPs by end of June 2009 - workshops planned IPStream sunsetting – consultation closed – webcall to review proposed framework and timescales BTW intend to trial Wholesale Content Connect (WCC) TDM/Ethernet (BTW) 2Mbit/s and above feasibility study recommended: –Retain majority of existing 20C PPC products –Incorporate 21CN components over time Work continues on sub 2Mbit feasibility

11 11 AIT Essentially situation as reported at December SCF Supplemental agreements to all industry players in June – lots of follow up Vast majority have signed to Supplemental Still some rejecters (currently 9) and no-responses (around 9) – predominantly small players. Now finalising references to Ofcom – obviously Ofcom require carefully and formal documentation Once submitted/accepted, Ofcom dispute target of 4 months for decision Reminder of 6 months notice period before takes effect

22 22 SIA General Contract Review Generally following review process agreed for MSA – though running a little late because of prioritised focus on MSA Some progress made re e.g. liabilities, force majeure, warranties, conduct of indemnified events Ongoing issues identified include pricing changes, pricing retrospection, interest rates BT working up a summary to help identify progress and unresolved issues More discussion required – need to agree programme with industry group Interconnect notification prepared to update wider industry of the situation – and point them to the website
