7 Division Initiatives - eTDEC Public Data Viewer Available On-Line Enforcement Module Complete for all Programs Solid Waste Information Available For: Inspections Complaints Permits Sometimes (populating with new applications) Asbestos Certification Program Forms

More Complete Solid Waste Permit Information Sporadically Available Starting to Create Hazardous Waste Information Infrastructure Just Starting to Populate this Data Viewer Have Seen Some Frustration from Stakeholders Not Being Able to Access HazWaste Information Similar to Solid Waste

13 Update on Solid Waste Program Issues Status of Regulations or Rules in the Following Areas Include: Composting – Received Final Rule Approval From UST & Solid Waste Control Board on August 4 th Rule Becomes Final in 4 to 5 Months After Completing Administrative Process Update Submittal Requirements to Support eTDEC Initiatives (add PDF requirement) – Near Future Erosion/Sediment Control Guidance Currently Holding Stakeholder Meetings Expect to Have a Draft Document for Board Review in October

14 Updates on Hazardous Waste Program Rule Changes Approved by Board Earlier in Year Pulls Rules Into Better Alignment With EPA Regs Have Deferred Addressing Drum Aisle Space Due To Stakeholder Concerns Rule Changes Impact a Number of Minor Issues Including: Inspection Standards Solvent Wipes Records Retention Variances

15 Updates on Hazardous Waste Program (cont’d) Upcoming Items Revised Definition of Solid Waste – Came Out in January Significant Impact to Hazardous Waste Recycling Legitimate Recycling Will Require Documentation (to Ensure Sham Recycling Not Occurring) Have Draft Regulation Out for Public Comment Coal Combustion Residuals Rules – Issued in December Most Rules Apply to Single Generator in Tennessee Regulations Look Mainly Like Subtitle D Except for Some Additional Requirements Beneficial Re-Use Will be Greatly Impacted

16 Update on Statewide Solid Waste Plan Information on What the Plan Is and Is Not The Plan is a Roadmap to Guide Future Activities The Plan is Not Law, Rule, or Regulation and Has No Enforcement Authority Associated with it The Plan Will Form the Basis for Legislation, Rules, or Regulations That Will be Deemed Necessary Any Legislation Will Go Through the Political Process Rules and Regulations Will Go Through Stakeholder Meetings and the Board

17 Update on Statewide Solid Waste Plan (cont’d) Broad Solid Waste Plan Goals: Divert Valuable Raw Materials Away From Disposal For: Conservation of Landfill Airspace Capture of Materials for Beneficial Use Attract Industry to TN to Use These Materials as Feedstock Assist Industry to Create Wealth for TN Develop Recycling Infrastructure to Make This Possible Assist Municipalities in Creating This Infrastructure Provide Grants to Support Infrastructure Development Encourage Private/Public Partnership to Involve Private Capital and Managerial Expertise to Effort Develop Funding Mechanism to Support This Effort

18 Legislative Update Last Year Legislative Session Summary Removed EAF Slag From Being Defined as Solid Waste Add the Definition of “Shredded” to Tire Bill (Allows Greater Flexibility to Landfill Tires) Establish a Solid Waste and Recycling Advisory Committee Changed the Way the Tire Grant Program Worked (already discussed) Results From Current Legislative Session Governor’s Agenda Includes Only Housekeeping and Clean-up Items Tire Surcharge From New Car Sales to Fund Research on Tire Beneficial Re-Use
