WHO GAVE YOU THE RIGHT? THE UNITED STATES CONSTITUTION BILL OF RIGHTS. Ch. 4-5

Pay Attention to the New Stuff DO NOT copy the stuff in italics DO NOT COPY THE REVIEW PAGES.

REVIEW: DO NOT COPY WHAT IS FEDERALISM WHAT IS THE CONSTITUTION? WHY IS THE CONSTITUTION IMPORTANT? WHERE DOES THE GOVERMENTS POWER COME FROM? WHAT IS THE NAME OF THIS THEORY CALLED? WHAT ARE THE THREE PARTS OF THE CONSTITUTION?

The Bill of Rights Individual Rights were extremely important for our founding fathers. (Why might you think this was so?) In 1791 the Bill of Rights were added. They were mainly added because of the principal of Federalism. The Bill of Rights protect our Civil Liberties.

CIVIL LIBERTIES Civil Liberties are the freedoms we have to think and act without government interference or fear of unfair treatment. The first amendment of the constitution protects some of our most basic Civil Liberties. Freedom of…religion, speech, press, assembly, petition of government.

Freedom of Speech In some countries people can be jailed for saying certain things. In America, we can say ALMOST anything we want, whenever we want, to whomever we want. Should the internet, mail, e-mail, art, and music be considered forms of speech?

Freedom of Religion In some countries only certain religions are permitted. In other countries, all religions are forbidden. In the U.S. we can worship whatever religion we want, in ALMOST whatever way we want? Do religions such as Satanism and some versions of Militant Islam fall under this Civil Liberty?

Freedom of the Press In the U.S., Freedom of Press refers to any printed materials. This ensures that Americans are exposed to a variety of viewpoints. Should printed materials that are demeaning to others be protected under this freedom?

Freedom of Assembly The freedom of Assembly protects our right to get together in groups and discuss ideas, protest, have parades, rallies, and meetings. The only catch…..the meetings must remain peaceful! Should groups such as the KKK be allowed to meet and have rallies and meetings?

Freedom of Petition The freedom of petition guarantees that all people may form a document or a petition (a formal request) and bring it before the government. Could a petition be brought forth to dissolve the government?

Review: Do not copy What are our five basic civil liberties? Which Amendment gives us these civil liberties? How do we decide how far these liberties go?

LIMITS OF FREEDOOM Even though we have civil liberties and a Bill of Rights, we do have limits on what we can do. Generally speaking, you may enjoy your freedoms as long as they do not endanger others or the government. The first amendment was never intended to allow people to do as they please. “The right of the individual must be balanced against the right of many!”

Other Amendments See page 110

WHICH IS WHICH? Write down the amendment that protects you from the following (if any do). 1. Can the government keep you from purchasing and keeping firearms? 2. Can your school locker be searched at any time? 3. Can you be tried for the same crime more than once? 4. Can the government come and take your land without buying it? 5. Can your trial be prolonged unnecessarily?

ANSWERS 1. Second Amendment 2. None (why not the Fourth?) 3. Fifth Amendment 4. Fifth Amendment 5. Eighth Amendment

NEXT ASSIGNMENT Turn to page 108 As a group, read the article. Decide whether the supreme court acted wrongly in allowing the Tinkers to wear their armbands. As a group, write 1 paragraph about why they (the supreme court) acted correctly or incorrectly. Make sure you use which amendments of the constitution you think were/were not being violated.

Next Assignment (last one I promise) As a group, decided what the greatest right that we have as American is. You must choose a single right, and write a single paragraph about why you think this.

Next Assignment (I Lied) Give all of the answers/writing your group has done to the leader. Make sure your group includes the work done the day you were asked to come up with a Bill of Rights for your group.
