Project Data and Staff Analysis 1)Site consists of two combined “out parcels”, 54 ft. x 109 ft. 2)Surrounded by platted residential lots within Southchase subdivisions. 3)Subdivision development around the site resulted in site’s frontage positioned horizontally facing the street, resulting in narrow (54’) lot depth. 4)Property owner Mrs. Jaffe obtained rezoning approval: A-1 to R-1 (P&Z 12/15/05) for future sale of site with R-1 setbacks. 5)Applicant Towanda Hannah is contract purchaser. Variance request to reduce front and rear yard setbacks due to narrow lot depth.

BZA Findings January 2007 BZA Hearing: Southchase HOA representatives concerned about compatibility. UPDATE Public Information meeting held April 2 nd. HOA officers present and in agreement with request. Neighbor to east opposed based on differences between his house size and applicant’s.

BZA Recommendation: Approved the Variance request in that the Board made the finding that the requirements of Orange County Code, Section 30-43 have been; approval is per Revised Site Plan dated/Received January 23, 2007, and restricting the house size to 2, 200 square feet of living area and 2,723 square feet gross square footage. (unanimous)

Additional Conditions Prior to permitting, the subject property shall be included in the Southchase Phase 1A Homeowners’ Association (HOA), and be made subject to the Covenants, Conditions and Restrictions governing Southchase, provided the Southchase HOA legally accepts the inclusion of the subject property (according to the procedures set forth in the Covenants, Conditions and Restrictions governing Southchase) within 90 days of a written request from the owner of the subject property.
