3 TOM TORLAKSON State Superintendent of Public Instruction Title III Invoicing Invoices for fiscal year (FY) 2008–09 occurred in mid-January for those local educational agencies (LEAs) that had unexpended funds for FY 2008–09. 3

4 TOM TORLAKSON State Superintendent of Public Instruction Title III Payments Fiscal Year 2009–10 Third and fourth apportionments were released in December 2010 and should have been received by county treasurers in January. LEAs with remaining balances for FY 2009–10 will receive payment through the Cash Management Data Collection (CMDC) system. 4

7 TOM TORLAKSON State Superintendent of Public Instruction Title III 2010–11 Notices of Apportionment A letter dated December 13, 2010, was mailed to LEAs detailing apportionment information and new payment and reporting protocols. Per pupil amounts were $105.75 for Limited English Proficient (LEP) and $105 for Immigrant Student Sub-grant Programs. The directory listing of direct-funded and consortia with funding amounts for the LEP and Immigrant programs can be found on the Title III Notice of Apportionments 2010-11 Web page at http://www.cde.ca.gov/sp/el/t3/tiiiapportnotify1 0.asp. 7

Warrants were mailed and should have been received by county treasurers in January. 9 TOM TORLAKSON State Superintendent of Public Instruction The Consolidated Application II The Consolidated Application (ConApp) –Deadline was January 31, 2011 –LEAs reported obligations for FY 2009–10 and 2010–11 Legal obligations: “Commitments made by an LEA to purchase goods or services immediately or in a future period” Title 34, Part 76, Section 707 from the Code of Federal Regulations (CFR): Retrieve by CFR Citation Web page found at http://www.gpoaccess.gov/cfr/retrieve.html (Outside Source). 9

10 TOM TORLAKSON State Superintendent of Public Instruction The Student National Origin Report The Student National Origin Report (SNOR) is the annual count of immigrant students. A “No SNOR letter” (for FY 2009–2010) was mailed in February. If there are no immigrant students, a report is still required for determining funding eligibility for future years. Non-submission of SNOR data can impact eligibility for Title III immigrant funding for up to three years. 10

11 TOM TORLAKSON State Superintendent of Public Instruction Immigrant Student Definition Immigrant children and youth are individuals who: 1) Are aged 3 through 21; 2) Were not born in any state; and 3) Have not been attending one or more schools in any one or more states for more than three full academic years. The Elementary and Secondary Education Act defines “State” as: –Each of the 50 states; –The District of Columbia; and –The Commonwealth of Puerto Rico. 11

15 TOM TORLAKSON State Superintendent of Public Instruction Private School Request to Participate-Immigrant Private schools in the jurisdiction of Title III-Immigrant eligible LEAs will be asked to submit a request to participate in the Title III Immigrant program via online reporting, due in June 2011. A letter detailing the process will be mailed to private school administrators in early May 2011. 15

16 TOM TORLAKSON State Superintendent of Public Instruction Private Schools-Limited English Proficient On ConApp I, LEAs will be asked to report two things on the private school page –the private schools they will serve with Title III LEP funds in 2011–12; and –the private school students they served with Title III LEP funds in 2010–11. LEAs will be reimbursed in 2011–12 based on the private school students served in 2010–11 as reported by the LEA on ConApp I. 16

LEAs generating less than $10,000 apply via the online consortia application process. –A letter detailing application information is anticipated to be mailed in early May 2011 to consortia eligible LEAs. 18

26 TOM TORLAKSON State Superintendent of Public Instruction Title III Year 2 and Year 4 Local Educational Agencies in Improvement Status The California Department of Education (CDE) California Comprehensive Center (CA CC) at WestEd County Office of Education (COE) Regional Leads, per the agreement of services with the California County Superintendents Educational Services Association (CCSESA) Have co-planned and delivered in the last four years, technical assistance to local educational agencies (LEAs) failing to meet the Annual Measurable Achievement Objectives (AMAOs) 26
