2 Why is Consent Important? SEXUAL activity is NOT SEXUAL activity without CONSENT! Consent is not only SEXY… It’s the LAW!!

3 Consent? Voluntary, sober, MUTUAL, honest, & VERBAL AGREEMENT FREELY GIVEN – not coerced/forced & does not involve pressure, intimidation, or threats ENTHUSIASTIC yes NEVER assumed or implied Process – must be given EVERY step of the way Can be WITHDRAWN or changed at ANY POINT during sexual activity

4 NOT Consent? SILENCE or NOT responding Lack of physical resistance CANNOT be given by someone who is: o INTOXICATED by ALCOHOL/DRUGS (voluntarily or not) o Asleep, unconscious/unaware, or has an inability or diminished capacity to consent Sexual arousal alone Appearance or clothes Confusing or UNCLEAR communication o “Wanna go back to my place?” (ONLY to go to your place) Underage person

6 Rose & Miguel have been going out for several months, but they have not had sexual intercourse. Tonight, the touching has gone further to touching the genital areas. Rose & Miguel have decided to take their relationship to the “next” level, & they begin to engage in oral sex. Both parties are actively enjoying this activity (oral sex). Miguel then places Rose on her back & proceeds to intercourse. Rose remains passive & becomes silent.

7 Got Consent? Kim & Jake are dating. They are “hooking up” in Jake’s room one afternoon, & Kim feels like things are going too fast. Jake tells Kim, “I thought you really liked me & this could be a special time.” Kim really likes Jake, but doesn’t want to move too quickly. Jake says to Kim, “We’ve been going out for a while, & I’ve been waiting a long time.” He then says, “Come on, Kim, it will be special.” After some persuasion, Kim finally gives in to his requests & the two have sexual intercourse.

8 Got Consent? Rachel & Michael have talked about having sex before & want to wait until both are fully ready. Although Rachel & Michael have not had sex, the two have agreed that Michael will start carrying condoms with him just in case. One day, the two are in Michael’s room & start making out. Soon, one thing leads to another. Both Rachel & Michael have their shirts off when Michael asks if he should get his condoms. Rachel shakes her head ‘yes’ enthusiastically & says, “Yes, hurry back!”

9 Got Consent? John & Kate have been drinking at a party, & Kate invites John to come to her house afterward. When the two get to Kate’s house, they have several more drinks and talk. They hold hands & begin to kiss. Then, they proceed to take off their clothes. Kate slurs her speech & stumbles getting onto the bed. John helps her onto the bed & proceeds to intercourse. John notices that Kate seems tired & out of it, so he hurries & finishes so that they can go to sleep.

10 Got Consent? Jessie & Vic have been flirting all semester, & agree to meet at a party. After dancing for a while, Vic proposes to go to one of their rooms & Jessie agrees. Once in the room, they begin touching. Each is interested in hearing what the other wants, & each pays attention to the other’s signals. At one point, Vic is not sure if Jessie is enjoying a specific sexual act, so Vic asks, “How does that feel?” Jessie responds by saying, “That is really turning me on. Can I do it to you next?”

Spoken consent is recommended for: o A new sexual relationship, or when you or your partner are new to sex o Those who’ve been sexually assaulted or abused Communicate with partner Be sensitive & pay attention to small signals Never pressure or force Accept that sometimes consent changes
