2 What is the Federal System? The system in which power to govern is shared by both the national government and the states  Important note:  Federal government = usually refers to the central national government itself (ex: Federal Court system)  BUT, Federalism/Federal System = relationship of shared powers

3 Supremacy Clause Article 6, Clause 2: United States Constitution, federal statutes, and U.S. treaties are the “supreme law of the land”  If conflicts arise between state and national legislation, the national law rules

4 National Government v. State Governments Responsibilities:  public health, safety, and welfare Powers Denied:  making treaties, declaring war, having an army, coining money Responsibilities: – foreign policy, regulating commerce Powers Denied: – marriage and divorce laws, regulating education, conducting elections

5 Cooperation Between National and State Federal Government protects states from invasion and domestic violence States hold national elections and handle voting for the federal government  26 th Amendment: changed voting age  1965 Voting Rights Act 1965 Voting Rights Act

6 ** The expansion of the national government’s powers into areas traditionally reserved to the states has altered the relationship between the two governments **relationship

7 Cooperation between States Extradition  Deporting a person accused or convicted of a crime, back to the state these charges are held If you are married in one state, then all other states must accept that marriagemarriage  Is this always true? What is one example from the past? What is one example that may happen in the future?

9 Virginia Constitution First state to adopt its own constitution in 1776 after the Declaration of Independence Highest law in Virginia Similar to the U.S. Constitution:  Establishes three branches  Executive, legislative, and judicial  Includes a Bill of Rights  Can be amended

10 Dillon’s Rule municipal governments have only the powers expressly granted to them by the state legislature For well-established county functions, like planning, zoning, and taxation, there are a number of statutes that give the county clear direction and authority to act, but in new areas of governmental concern, the Dillon Rule can serve as a constraint to innovative governmental responses.

11 Executive Branch Governor  4 year term  cannot be elected to two consecutive terms  Roles of the Governor:  chief of state  chief legislator  chief administrator  party chief  commander-in-chief  Governor can propose legislation in the annual State of the Commonwealth address Terry McAuliffe (Dem.)

12 Powers of the Governor Personal  Public perception of performance  If seen as a positive influence, they continue to add to their power Institutional  Provided by the state constitution  Power of Appointment: deciding key positions  Legislative: veto, control over budget

13 Executive Branch Lieutenant Governor  4-year term  Elected separately from the governor  Can run for re-election  President of the Senate of VA Ralph S. Northam (Dem.)

14 Executive Branch Attorney General – 4 year term  His firm:  Provides legal advice and representation for the Governor and state government in general  Defends the state in cases of criminal appeals and suits against the state  Defends the constitutionality of state lawsstate laws Mark R. 15 (continued) Cabinet Secretaries & departments, agencies, commissions, and regulatory boards  Administer & enforce laws  Regulate aspects of business and the economy  Provide services  Secretaries of Finance, Public Safety, Education, Finance, Agriculture and Forestry, etc.

16 Legislative Branch The General Assembly  Bicameral legislature  House of Delegates (100 members)  Senate (40 members)  Meet annually for a set number of days (30-60)  Not a full time job  Current Make-up:  Democratic Majority in House  50/50 split in Senate (where our Democratic Lt. Governor serves as tie breaker)

17 Roles of the Legislative Branch Write law and take action in response to problems or issues Lawmaking process  Introduce a bill  Work in committee  Debate on the floor of each house  Both houses vote on the bill  Governor signs or vetoes bill Taxation bills must begin in the House of Delegates

18 Influences on Legislative Policymaking Must compromise between the two chambers Time  Leaders must decide which bills are priority and will make it to the floor for debate  Beginning of session is usually mostly committee work; end of session involves (sometimes frantic) debate and voting Electoral cycles  Senators: 4 year terms  Delegates: 2 year terms  Highly controversial topics are less likely to be considered during election years

20 Influences on Legislative Policymaking Ballot Initiatives  a proposal to change or create a law at a local or state level  citizens can bring about a public vote on a proposed statue by gathering a pre-determined amount of signatures from registered voters and turning those signatures in to the state Referendum  places a law that has already been passed by the legislature to a popular vote **In Virginia, these are only allowed at the local level; no state laws can be passed by initiative or referendum

22 Virginia Judicial System Organization and jurisdiction derive from Virginia’s Constitution and state laws Magistrate  Civil officer or local official  provide an independent, unbiased review of complaints of criminal conduct brought to the office by law enforcement or the general public  Set bail, issue search and arrest warrants, subpoenas

24 Virginia Juvenile and Domestic Relations District Court Judge, no jury Handles juvenile and family cases

25 General District Court Judge, no jury Original jurisdiction of misdemeanors Handles civil cases less than $1,000

26 Circuit Court Judge, sometimes jury Both Original and Appellate jurisdiction  Original Jurisdiction of felony criminal cases and civil cases over $1,000  Appellate jurisdiction from district courts

27 Court of Appeals (of Virginia) Judges, no jury Appellate jurisdiction from circuit courts  review of final decisions of the circuit courts in domestic relations matters, appeals from decisions of an administrative agency, traffic infractions and criminal cases, except where a sentence of death has been imposed.

29 Which Court would each person start in? Claire, a 13 year old, is caught stealing a pie from the local bakery. What court will she go to? Kevin hit James’ truck while he was trying to park. When the drivers got out of their cars to discuss insurance, James punched Kevin in the nose; now Kevin is suing James for medical bills. What court will see their case if Kevin’s medical bills are under $1,000? What if they are over $1,000? Quinton has just been convicted of robbing a gas station, but continues to claim that he is innocent. Where would he take his case in attempt to change the outcome?

31 Where do they get their power? All authority of local governments is derived from the state  Given by Constitution of Virginia and other acts of the General Assembly **Not all cities and towns have the same power.  Cities and Towns must have charterscharters

33 Lawmaking Process To enact an ordinance : to put forth a local law or piece of legislation  Charlotte County has several leash laws, curfew Individuals can have the greatest influence on the decisions made by local government officials, because they are closest to them

34 Counties of Virginia Largest by population: Fairfax County (1.1 million people) Largest by area: Pittsylvania County (978 sq. miles) Highest population by square mile: Arlington County (over 7,000) Charlotte County! Population: 12,505 Area: 477 sq. miles Population by square mile: 26.5

35 County-Level Organization Board of Supervisors  Elected  Legislative Powers  Enacting ordinances  Adopting annual budget and appropriating funds School Board  (Also part of city organization) each has an elected or appointed school board  Oversees operation of K-12 public schools

36 City or Town Level Organization City/Town Council  Elected  Legislative powers  Enacts ordinances & adopts annual budget Mayor  Elected by either voters or town council members  Executive Powers Manager  May be hired by to oversee the operations of the local government  Either appointed by the Mayor, or the elected legislative branch

37 Every Locality Must Have: Sheriff  Responsible for keeping the peace  responsible for criminal investigations, calls for service, court room security, maintaining jails Clerk of Circuit Court  Maintain the records of a court  Issues marriage licenses  Records of marriages & divorces, wills, deeds, births & deaths, etc. Commissioner of Revenue  Chief tax-assessing official; determines what is taxable Treasurer  responsible for the collection, custody and disbursement of all funds

38 Charlotte County Organization Board of Supervisors:  Seven members, one from each election district  Staggered terms  To ensure that there is are at least some experienced members  Meet every second Tuesday of the month at 1:30 p.m.  Appoint members to other Boards such as the Library Board, Local Emergency Planning Committee, Board of Building Code Appeals, etc.  $6,000 stipend School Board:  Elected (but this changed only recently from appointed)  $4,800 stipend
