Folie 9 Jurisdiction Arbitration agreement or arbitration clause At least one party shall have its residence or place of business outside of Austria, or if both parties have their residence or place of business in Austria, the dispute must be of “international character”

Folie 10 Arbitrability “Any pecuniary claim that may be determined by ordinary courts can be subject of an arbitration agreement. An arbitration agreement regarding non-pecuniary claims shall be legally effective insofar as the parties are entitled to conclude a settlement on the subject of the dispute.” (Section 582 para. 1 of the Code of Civil Procedure) Claims in matters of family law, Austrian Landlord and Tenant Law, Condominium Law, are not arbitrable. An arbitration agreement on Labour Law disputes may only be effectively concluded after the dispute has arisen. Restrictions for consumers
