Obtaining Ballot Status 2006 Elections –All partisan and independent candidates –File during two week filing period March 6 through 5:00 PM March 17

Partisan Candidates Options Declaration & pay $40.00 filing fee. Declaration & signatures of 5 registered electors Signatures on County Commissioner Petition must be from candidate’s respective district. Precinct committeemen – Declaration only.

Independent Candidates File a declaration accompanied with signatures on petition.

Magistrate Judicial Candidates 2006 Election –File 90 days prior to the general election. –Last day to file – August 9 Notify Magistrates of filing requirements in July. Magistrate Judge should check with Administrative Office of the Courts if they are not sure if they are up for retention.

Filling Vacancies Vacancy exists only when; –One candidate of a political party files for the office –and withdraws –or a vacancy occurs due to Death or Disqualification

Candidate Withdrawal Candidate must file a notarized statement of withdrawal with the County Clerk. Last day to withdraw is not later than 45 days before election: –PrimaryApril 10 –GeneralSeptember 7

Death or Disqualification Vacancies occurring due to death or disqualification within 10 days of the Primary Election are filled after the Primary.

Filling Vacancies County Central Committee must fill vacancy within 15 days from when the vacancy occurred. Appointee must pay filing fee and file a declaration in order to have name placed on ballot.

Write-In Candidates With the County Clerk A person must file a notarized declaration of intent Not later than 14 days before the election

Successful Primary Write-In Candidate Shall: –Pay the filing fee Except precinct committeemen (34-1208, I.C., 5 votes to be elected) and –File a declaration of candidacy within 10 days after the county canvass in order to have name placed on general election ballot.

Candidates Filing with SOS Same filing period as county candidates –Federal –Statewide –Legislative –Judicial District
