Acknowledgement of country
We acknowledge that the lands that we meet on today are the traditional lands of the Kaurna people and we respect their spiritual relationship with their country. We also acknowledge the Kaurna people as the custodians of the greater Adelaide region and that their cultural and heritage beliefs are important to the Kaurna people today.

Consultation Process review of existing Charters / Codes & the key
principles (H&CSC Act section 22) internal discussion with HCSCC & Project Reference Group public consultation across health & community services sectors - service users, carers, service providers, other stakeholders comments received by 11 August 2010 will be considered by Reference Group proposed Charter will be presented to the Minister for Health, with consultation report, by 1 October 2010

Health & Community Services Complaints Act (2004)
In developing the Charter, the Commissioner must have regard to the following principles (section 22): that a person should be entitled to… participate effectively in decisions about the services provided take an active role be provided with appropriate services, taking into account their background obtain reasonable access to their records confidentiality have access to complaints procedure and that professional and non-professional providers should be given consideration and recognition for their contribution

How will HCSCC use the Charter?
Section 85 of the Health & Community Services Complaints Act (2004) says that: (1) in determining whether a health or community service provider has acted reasonably, HCSCC must have regard to: the Charter; and the Charter principles (section 22); and the generally accepted standard that would be expected of a health or community service provider, and may have regard to any other matter or information that HCSCC considers relevant. (2) HCSCC must in making a decision, take into account the level of resources reasonably available to the health or community service provider.

What they did was reasonable - HCSCC takes no further action What they did was unreasonable Outcome may include: an apology, future plan for service user, action to prevent it happening again, recommendations for service improvement, monitoring progress.

Ongoing role of the HCSCC
Section 9 (1) of the Health & Community Services Complaints Act (2004) requires HCSCC to: (a) to prepare and regularly review the Charter; and (d) to provide information, education and advice in relation to- the Charter; and health and community service rights and responsibilities. It is likely that these functions will be completed in conjunction with the HCSCC Advisory Council.
