4. Who is authorised to the use the resource? Any person who is a current student (undergraduates and postgraduates), member of staff (whether on a permanent or temporary basis) or a contractor of the institution Any person who is NOT a current student (undergraduates and postgraduates), member of staff (whether on a permanent or temporary basis) or a contractor of the institution, but who is permitted by the institution to access its secure network from computer terminals while the person is located physically within the library premises.

5. What about remote access? The Model NESLi2 Licence allows the institution to provide 24/7 access for multiple users, simultaneously using secure authenticated access such as ATHENS to any member of staff and students of the institution Walk-in Users cannot be given remote access rights. They can only use the resource while physically located within the library premises, using computer terminals on the secure network

6. What does the Model Licence allow? The Model NESLi2 Licence allows all students, staff and Walk-in Users for educational purposes to use parts of the resource for: Teaching and training staff and students whether on campus or not Student coursework (including project work and dissertations) Research activities Presenting research professionally e.g. in a conference presentation, or in papers

7. What can the institutions do? The institution is allowed to make a local cache. This is particularly helpful where staff wish to use a resource during a teaching session, and want to guarantee speedy and reliable access by using a local copy of the resource (rather than relying on access via the web) Access to the cached version must still be authenticated and is subject to the same terms and conditions as any other use

8. What about cancellations The Model NESLi2 Licence seeks to permit the institution to make annual cancellations and substitutions of the licensed material (only applicable for multi-year agreements)

Cutting and pasting for teaching and learning Staff and students may ‘incorporate’ parts of the resource in teaching materials, coursework and dissertations providing it is appropriately acknowledged This is not limited to a particular medium and can include materials on CD, or through authenticated access to institutional VLEs or intranet

10. How can the resource be used to support research activity? Staff and students can search and look at their results on screen Save extracts electronically to a computer hard drive, floppy disk, CD-ROM, USB flash drive etc Print out single copies of extracts from the resource, for example journal articles, images, search results etc Publicly display or present as part of their work at seminars, workshops or conferences

11. What library services are allowed? Inter-library loan by document delivery of a single copy using software such as Ariel Provide print and electronic copies of part of the resource at the request of staff and students Download extracts for training and promotion

13. Technology driven changes Walk-In Users may only access Licensed Material via wireless network provided by the library network is a secure Secure Authentication based on Shibboleth technologies rather than Athens Walk-In Users not limited to the library – but the ‘premises’ of the institution

14. Consideration for repositories JORUM is a central repository of learning and teaching materials Authorised users may now not only incorporate parts of the Licensed Material in learning materials they create, but now also deposit those learning materials in perpetuity in the JORUM Repository

Self Archiving Authorised users may save and/or deposit in perpetuity parts of the Licensed Material of which they are the authors on any network including networks open to the public and to communicate to the public such parts via any electronic network, including without limitation the Internet and the World Wide Web, and any other distribution medium now in existence or hereinafter created

17. Open Choice Model In the event that the Publisher offers the open choice model to its authors, the Publisher agrees to: Annually review the number of open access articles published under the open choice model and the number of articles published under the traditional subscription model and in case of a decrease of the amount of traditionally published articles in comparison to the previous year, the Publisher will reflect such decrease by way of a reduction in the subscription prices for the following subscription year. Such reduction shall be based on the percentage of open access articles published in the Material in the previous year Annually provide JISC Collections with a list of open access articles published in the Material under the open choice model by authors of the Institutions Provide a discount in the authors fees of … for the period to Institutions and their authors which subscribe to the Material on the basis of the Offer.

18. Confidentiality The parties acknowledge and agree that the obligation to respect confidentiality of the other’s confidential information will survive any expiration or termination of this Agreement. The Publisher hereby recognises and accepts that JISC Collections has an obligation to comply with the Freedom of Information Act and that this obligation takes precedence over the obligations in this Clause.

Meeting the changing needs of academic institutions Institutions are changing and evolving to meet the diverse needs of their users; overseas campuses are being opened, new commercial activities and spin out companies are being developed and franchised courses are being offered in partner institutions

21. New technology new opportunities Federated access based on Shibboleth technologies operate at a granular level and offer the opportunities for new models – and new definitions of the ‘Authorised User’

22. JISC Collections Licensing Workshops Workshops in November to explore how JISC (negotiating at a national level) can effectively evolve its licences to enable institutions to meet these changing needs and demands which are often at the local level or unique to each institution
