EPOCA – 11. June 20083 Intellectual Property Definitions : Background = pre-existing knowledge Foreground = knowledge generated during the project Collaborative projects ► Access rights to another participant’s Back- or Foreground needed to fulfill its own work or/and use the generated knowledge

June 20084 Access rights (1) * Access rights to Background Acces rights to Foreground project implementation mandatory access? yes, if a participant needs them to carry out its own work under the project (GA art. II.33.1-2 CA art. 9-3-4) condition royalty-free (GA art.II.33.2; CA art 9.3-4) * use (exploitation, further research) mandatory access? yes, if a participant needs them for using its own Foreground (GA art. II.34.1-2 CA art. 9.5) condition upon written bilateral agreement royalty-free or on fair and reasonable conditions ** (GA art.II.33.2; CA art 9.3-4)* * subject to third party rights (access rights to Background) ** - royalty-free conditions for non-commercial internal research and teaching activities that enter into the scope of the project - conditions to be defined for Outreach activities that enter into the scope of the Project - fair and reasonables conditions in other cases (including Third Party research)

Access rights (2) EPOCA – 13. June 20085 Any Request for access rights shall be in writing The requesting party must show that Background and/or Foreground is needed (ie needed to carry out its own part of work under the project or to use its own Foreground)

Requirement for any dissemination activity All publications or any other dissemination relating to foreground shall include the following statement to indicate that said foreground was generated with the assistance of financial support from the Community : The research leading to these results has received funding from the European Community's Seventh Framework Programme (FP7/2007-2013) under grant agreement n° 211 384.
