2  This is a privately initiated request to amend Chapter 404.10 of the ULDC. The primary request is to reduce required setbacks from the property line from 200 feet to 100 feet.  The applicant is also requesting that the provision for all processing activities to occur in enclosed buildings be eliminated.

3  Alachua County staff are recommending that the 200 foot wide setback provision remain but that the Reviewing Board (in case of a special exception, the BoCC) be empowered to reduce that setback to as little as 100 feet with proper buffering.  Similarly, the provision for enclosed buildings can be removed provided that proper buffering is in place.

4 404.10Agricultural Products Processing, Packaging and Sale, Offsite Offsite agricultural products processing, packaging and sale is allowed as a limited use in the A-RB district or may be allowed by special exception in the A district, subject to the following standards. a) Sale of Products The extent of sale of products from such activities shall be determined as a condition of approval. b) Enclosure of Activities All processing activities shall be housed in enclosed buildings to the greatest extent possible. Where processing activities are not located within enclosed buildings, a medium density buffer, as defined in Table 407.43.2, shall be provided at the edge of the development area. c) Minimum Setbacks The minimum setback of any structure housing processing activities shall be 200 feet. The reviewing board may approve a setback of as little as 100’ where a medium density buffer, as defined in Table 407.43.2 is provided at the property line.

5  Staff recommends that the Board convene as the Land Development Regulation Committee (LDRC) and find the request consistent with the Alachua County Comprehensive Plan and Code. The Board can then reconvene and adopt Ordinance 10-xx with the Staff recommended Code changes.
