3 Summary of the Rule All facilities that meet the target rate are exempt from many parts of the rule (10.7 – 10.12) for the following year. If Hospital, Hospital Unit, or ASC does not meet the target rate, then they are required to implement an influenza vaccination policy that includes medical exemptions and masking requirement. All other facilities that do not meet target rate required to perform an assessment and develop updated policy. Medically exempt employees do not count towards the target vaccination rate.
