2 Respect Integrity Service Trust 2 Canada’s Commitment to Regulatory Improvement in the North July 2009 – Canada’s Northern Strategy to strengthen Arctic sovereignty, protect the North's environmental heritage, promote social and economic development, and improve and devolve Northern governance. September 2009 - Establishment of the Canadian Northern Economic Development Agency (CanNor) May 2010 - INAC Action Plan to Improve Northern Regulatory Regimes will complete and strengthen current regimes, focussing on: – more efficient and effective processes –enhanced environmental monitoring –reflecting a strong Aboriginal voice

3 Respect Integrity Service Trust 3 Establishment of CanNor and NPMO Canadian Northern Economic Development Agency (CanNor) Is Established: “Our Government is bolstering this Northern agenda through proceeding with the creation of a new development agency exclusively for the territories…[it] will consolidate Northern economic development programs, bolster economic growth in Aboriginal communities, select and coordinate critical infrastructure projects, and help the region's communities adjust to changing economic and environmental conditions.” –Prime Minister: Iqaluit, Nunavut, August 2009 Northern Project Management Office (NPMO) is Established within CanNor: “The new Northern Project Management Office will have direct responsibility for coordinating northern projects and will offer a single point of contact for clients. With a central office in Yellowknife, it will be well positioned to coordinate major natural resource projects across the North.” –Canada’s Economic Action Plan, News Release September 2009

4 Respect Integrity Service Trust 4 Establishment of CanNor and NPMO CanNor –Reports to Parliament through Minister of Indian and Northern Affairs, Federal Interlocutor for Métis and Non-Status Indians, and Minister of the Canadian Northern Economic Development Agency –CanNor is not part of Indian and Northern Affairs: separate Agency with own Deputy Minister –Head office located in Iqaluit –Liaison office in Ottawa Northern Project Management Office –NPMO emerged from recommendations in Neil McCrank’s July 17, 2008 Road to Improvement report –Doors opened May 3, 2010 –Headquarters in Yellowknife –Project coordinators in each territory: Whitehorse, Yellowknife, Iqaluit

5 Respect Integrity Service Trust 5 Purpose NPMO supports the economic development mandate of CanNor and helps to ensure economic prosperity by providing a project management service to clients, increasing transparency, timeliness and predictability in the Northern project review and approval process. NPMO’s clients are: –Project proponents –Federal partners –Territorial and Aboriginal governments –EA and regulatory boards –Aboriginal groups –Canadians NPMO coordinates federal regulatory participation, tracks project progress, coordinates Crown consultation and maintains the Crown consultation record on northern projects in its portfolio. NPMO works with federal partners, territorial and Aboriginal governments, regulatory boards, and stakeholders to facilitate improved communication and coordination and ensure environmental assessments and permits proceed smoothly on northern projects.

6 Respect Integrity Service Trust 6 NPMO Project Management NPMO provides project management services that: –Improve federal transparency and predictability around regulatory requirements and project timelines Project agreements NPMO Project Tracker –Increase federal accountability Memorandum of Understanding MP/NPMO Deputy Ministers’ Committee –Provide an integrated project management approach across the federal system Territorial Project Committees, DGs, ADMs Crown Consultation Coordinator

7 Respect Integrity Service Trust 7 NPMO Approach To support the CanNor economic development mandate, NPMO works with communities and industry to leverage CanNor and other government opportunities: –Mineral exploration and development workshops (commodity focused) –Funding to support development of Impact Benefit Agreements

8 Respect Integrity Service Trust 8 NPMO Project Management Services Providing pathfinding guidance to industry and others Coordinating federal roles and responsibilities related to Northern projects Working with partners to facilitate improved communication and coordination and ensure EAs and approvals proceed smoothly on northern projects Monitoring and tracking projects, identifying project specific and systemic issues and working with partners to resolve Facilitating a “whole of government approach” to consultation and maintaining the Crown consultation record for northern projects in its portfolio.

9 Respect Integrity Service Trust 9 NPMO Tools Integrated Governance Structure Memorandum of Understanding Project Coordination - Project agreements for new large northern projects - Workplans for existing large northern projects and others as recommended by the territorial project committees to DGs for approval Other projects could include those with complex issues or be of a particular federal interest NPMO Project Tracker

10 Respect Integrity Service Trust 10 Integrated Governance Structure NPMO Territorial Project Committees –One in each territory; “getting started” workshops late 2010/ early 2011 –Operational representatives of same departments as Major Projects/NPMO Deputy Ministers’ Committee; territorial governments and boards by invitation. –Project management –Each department reports up through respective HQ/regional approval processes to MP/NPMO ADM and DG committee members NPMO Federal Working Group –HQ and regional representatives of same departments as Major Projects/NPMO Deputy Ministers’ Committee –Review and advice in development of NPMO tools –Each department reports up through respective HQ/regional approval processes to MP/NPMO ADM and DG committee members Major Projects/NPMO Deputy Ministers’ Committee –Key Departments involved in major projects: DFO, TC, EC, INAC, NRCan, CanNor, CEAA, NEB and CNSC –Integrated oversight of major projects in south and north –Accountability –Issues resolution –DM Committee meets monthly; discussion of northern agenda bi-monthly –Supported by ADM and DG Committees, including DG Crown Oversight Committee

11 Respect Integrity Service Trust 11 Memorandum of Understanding Formal commitment among departments to coordinate their participation in the EA and regulatory review of northern projects through NPMO in order to improve effectiveness, efficiency and transparency Sets out roles and responsibilities of the parties, the governance and accountability framework and how Crown consultation will be addressed. CanNor, INAC, EC, DFO, NRCan, TC, CEAA, CNSC, NEB Will be signed by Deputy Ministers in 2010

12 Respect Integrity Service Trust 12 NPMO Project Criteria Large Northern Project Located, in whole or in part, in Yukon, NWT, or Nunavut, or offshore waters Resource or infrastructure project More than one federal department involved as a regulator or expert Will proceed through one of the following EA reviews: YESAB Executive Committee Screening, YESAB Panel or Joint Panel MVEIRB EA, Panel or Joint Panel EIRB Panel, CEAA Comprehensive Study or Joint EIRB/CEAA Panel NIRB Part 5 Review or a FEAP Part 6 Review Territorial project committees recommend to DGs for approval when a project in one of these reviews is in fact not a large project.

13 Respect Integrity Service Trust 13 NPMO Project Criteria Other Northern Project –Located, in whole or in part, in Yukon, NWT, or Nunavut, or offshore waters –Resource or infrastructure project –At least one federal department involved as a regulator or expert –Will proceed through one of the following EA reviews: YESAB Designated Office Evaluation In the Mackenzie Valley, a Preliminary Screening by a department(s) or land and water board In the ISR, a Screening by the EISC or a CEAA RA NIRB Screening

14 Respect Integrity Service Trust 14 Project Coordination Project Agreements New large northern projects Identifies roles, responsibilities, milestones and timelines for federal departments’ participation in EA, regulatory review and consultation with Aboriginal groups; provides transparency Signed by Deputy Ministers; provides commitment to timelines and accountability NPMO tracks project progress and reports to DMs. NPMO Project Tracker will be accessible to public; provides transparency Nunavut Project Agreement Template – Late 2010 Yukon and NWT Templates – Spring 2011
