Section 4-3 (a) Except as provided by subsections 4- 3(a)(1), (2) and (3) below, alcoholic beverages may be sold, consumed, served or permitted to be served or consumed, in any place holding a license under the Division of Alcoholic Beverages and Tobacco, state Department of Business and Professional Regulation, which license permits the consumption of alcoholic beverages on the premises of the licensee, only between the hours of 11:00 a.m. and 2:00 a.m of the following day, each day of the week.

Concerns Related to 4-3 Banquet halls can utilize a licensed caterer to circumvent current laws and Orange County Code. Licensed bars and nightclubs close at 2:00 a.m.

Crime Impact Increased calls for service have included: Traffic Complaints Excessive Noise Shots Fired Crimes Against Persons Robbery Stolen Autos The State Division of ABT has classified Santa Fe Club as an unsafe environment for the community.

Santa Fe’ Banquet Hall- 630 Emeralda Rd. Suite#105 56 Calls for service 4 Stolen Vehicles 1 Aggravated Battery 4 Auto Burglary However, within 88 yards (.05 mile) 285 calls for service

(Pegasus Banquet Hall) now Soiree’ Event Center- 6394 Silver Star Rd. 25 Calls for service 1 Commercial Robbery 1 Aggravated Battery However, within 88 yards (.05 mile) 221 calls for service

Zoning Variance A Zoning Variance was added on November 29, 2011to help combat the aforementioned issues. The variance imposes a 45-day limitation. Regulates on-premise consumption of alcohol Currently not being enforced.

Proposed Amendment to 4-3 Add additional language that restricts hours of sale and consumption of alcohol for licensed caterers Must be permitted by zoning
