What will the max total of points be on this FRQ? How do we know this? How can this ensure we answer all parts of this FRQ? Engel v. Vitale/Lemon v. Kurtzman – what First Amendment clause is this based on? What was the Supreme Courts decision? a.) Engel v. Vitale – 1.) struck down state sponsored prayer in school. 2.) Court said that the prayer demonstrated the state officially backed religion. b.) Lemon v. Kurtzman – 1.) Struck down state funding for private religious schools – struck down state funding paying parochial school teachers for teaching secular subjects. 2.) Three pronged lemon test.

C.) Oregon v. Smith/Reynolds v. United States – Free Exercise Clause D.) Reynolds v. United States – the decision restricted polygamy in the United States. They would not accept unconstitutional – why? It’s not a government action – a government action can be unconstitutional – this is a personal decision. Oregon v. Smith – the decision banned drug use in religious ceremonies. E.) Two ways in which other political institutions might limit Supreme Court decisions: 1.) Legislation 2.) Ignoring or refusing to enforce a Supreme Court decision 3.) Constitutional amendment.
