8 Fair Labor Standards Act The Fair Labor Standards Act is a 1938 federal law which established 40 hour work week and overtime standards For our purposes, the law divides employees into two groups – exempt and non-exempt Non-exempt employees (meaning those who are not “exempt” from the law must be given overtime when working more than 40 hours in a week.

9 Non-Exempt employees include: All AFSCME employees Almost all MAPE employees at 5L through 7L and many at 10L As well as lower level supervisory jobs

10 Exempt employees include: High level MAPE and supervisory employees and all managerial employees They are expected to work the hours it takes to get the work done, usually more than 80 hours/pay period These employees do not receive overtime or comp time Exempt Employees Exempt employees can be afforded more flexibility in hours Do not treat exempt employees as non-exempt
