3 Merely incidental effects When: the pith and substance of the law falls within the jurisdiction of the order of government that passed it; the pith and substance of the law’s provisions falls within the jurisdiction of the order of government that passed it OR the provisions are saved by the ancillary powers doctrine; and the law does not infringe the interjurisdictional immunity of another order of government, the law’s effects on the jurisdiction of the other order of government are merely incidental and, thus, constitutional. © Copyright 2013 Tolga R Yalkin
