Events The festival is planned and the committee is not concerned with checking I.Ds The four teenagers go to the festival and plan on drinking They consume large amounts of alcohol They decide to go to the opposite side of Lake Helen

Events Continued Yvonne cuts her foot on a sharp rock Michael suggests going in to the cabin to get a bandage for her foot They break into the cabin and they start throwing things at each other. Steve throws up on the carpet and soon after they leave the cabin

Events Continued Three days later the owners of the cabin, Bill and Jane Brown, return home. Their cabin was destroyed and the estimated damage was $10,000. The damage was reported and the police contacted Ed Rice because he was the one selling the beer to minors and remembered the four teenagers.

Events Continued The teenagers were identified and charged with breaking and entering, vandalism, and underage drinking The Teenagers had to pay $400 as well as serve 80 hours of community service. Once the Browns learned that the committee did not plan to check IDs they decided to sue the festival committee.

Affidavits and Depositions Ed Rice revealed that he was not instructed to check IDs or refuse to serve people who were already intoxicated Cheryl told the attorney that the committee knew of the issue of underage drinking,but decided to drop it because it was too much of a hassle

Affidavits and Depositions Jonathan Allen said that he did not instruct the servers to check IDs and he revealed that the committee did not plan on changing that in the future because it was too hard. The four teenagers admitted that what they did was wrong, however they all felt strongly that had they not been drunk they would not have committed the crime.

Civil Damages Act 1994 Subdivision 1 Cause of action If someone suffers an injury by an intoxicated person, the person who received the injury can sue the person who caused the intoxication The Browns have the right to sue the committee because they provided the minors with alcohol, which resulted in the damage.

Jones v. Any town Raceway, Inc. Ruled that in order for someone to sue for negligence the plaintiff must prove the dependent had the responsibility that he or she did not meet The festival committee had a responsibility to follow e laws and not sell alcohol to minors and they failed to do that

Hacker v. Any town American Legion No. 600 Ruled that when an intoxicated person causes harm to somebody else after consuming alcohol that was purchased illegally the person that provided the alcohol can be held responsible for the damages. The committee should be held responsible because they provided alcohol to underage teenagers,which resulted in property damages

Relevant Facts Alcohol use often precedes violent events, including vandalism. Violent acts including vandalism are more likely in an enviroment where alcohol is readily available. Social polices at discourage alcohol useppear to reduce the yes of violence

Outcome The Browns should win the suit because the festival committee provided minors with alcohol which led to the damages. The committee should be held responsible for all damages and should be required to change the rules for future festivals regarding checking IDs
