To sue or not to sue Our professions tend to be on a low end of the malpractice pendulum, but suits have increased due to: – Technological advances – Involvement of more professionals and nonprofessionals in the tx of a client – Inadequate disciplinary action – Increase in number of attorneys who take malpractice cases – Decreased tendency for consumers to treat professionals with the same respect & reverence as in past – Increased entrepreneural opportunities – increase suspicion in public eye – Increased in amount of damages awarded by jurors

Definition of clinical values Autonomy – a commitment to respect an individual’s independent actions and choices Beneficence – an obligation to convey benefits and to help others to further their legitimate interests Confidentiality – an implicit understanding that information divulged by the patient to a professional will not be revealed to another person Harm avoidance – an obligation not to inflict evil, harm, or risk or harm on others Justice – an equal distribution of benefits and burdens and fair allocation of scarce resources Professional responsibility – an obligation to observe the rules of professional conduct with patients, colleagues and the community Truth – the disclosure of all pertinent info including that which may reflect poorly on the informer

Overview of the Principles Aud – Principle I – “provide professional services with honesty and compassion, and shall respect the dignity, worth and rights of those served. – Principle II – ‘high standards of professional competence in rendering services, providing only those professional services for which they are qualified by education and experience” – Principle III – confidentiality of the records and info of those receiving services – Principle IV – only provide services and products in the best interest of those served – Principle V – accurate info of the nature and management of comm disorders and about the services and products offered – Principle VI – comply to the ethical standards of the academy with regard to public statements – Principle VII – honor their responsibilities to public and colleagues – Principle VIII – uphold dignity of the profession
