9 9 Links between Jersey & Portugal/Madeira  Immigrants from both Portugal & Madeira arrived in the early 1960’s  6% of Jersey’s population were born in Portugal/ Madeira (Approx. 5150 people)  We now have 3 rd & 4 th generation individuals living on the Island  Official Twinning of our Capital towns

11 28.11.1111 Legal Framework  The Probation Service is a department of the Royal Court of Jersey  Loi (1937) sur l’attenuation des peines et sur la mise en liberté suveillée. (Probation Law)  Criminal Justice (Community Service Orders) (Jersey) Law 2001  Criminal Justice (Young Offenders) (Jersey) Law 1994  Sex Offenders (Jersey) Law 2010

12 28.11.1112 Probation Officers and Team Our team consists of:  Chief Probation Officer – Mr Brian Heath  Assistant Chief Probation Officer – Mr Mike Cutland  Team Leader – Mr David Trott  13 Probation Officers  5 Assistant Probation Officers  4 Case Management Assistants Majority of Probation Officers & Assistants are Social Work qualified or in training with placements in Scotland/Northern Ireland and now Madeira in 2012.

14 28.11.1114 Parish Hall Work  Attend Parish Hall Enquiries (PHE) to assist Centeniers in dealing with under 18’s  Restorative Justice  Voluntary Supervision  Family Problem Solving  Referrals to Other Agencies If offence is dealt with at Parish Hall, the young person does not get a Criminal Record.

20 28.11.1120 So who is Placed on Probation?  Evidence that Probation is most effective in working with Medium and High Risk offenders  90% have previous convictions  25% have previously served a custodial sentence In 2010 there were154 Probation Orders imposed of which: 35 – Youth Court 94 – Magistrate Court 25 – Royal Court

21 28.11.1121 Probation Orders  Cross tariff, instead of a sentence  Requires consent  Agreement between Court and Probationer supervised by the Probation Officer  Support and Control

22 28.11.1122 Probation Orders  Supervision Standards agreed with Royal Court  Continuity principle – SER writer/Supervisor  Addressing dynamic risk factors identified by LSI-r through Pro social modelling and Problem solving (Trotter) and Strength based approaches.  All assessed for risk of harm  All complete a short offending behaviour programme

26 28.11.1126 Management of Risk There are two main formats in assessing management of Risk  RAMAS – Risk Assessment Multi-Agency Support  JMAPPA – Jersey Multi Agency Public Protection Agencies

27 28.11.1127 Community Service (CS)  Operating since 1982  11 staff – Assistant Manager Mr A. Le Marrec – a.lemarrec@gov.je a.lemarrec@gov.je  A direct alternative to prison  Over 200 Orders a year  Minimum resources required  Involuntary clients  Individual, group and work room  Fit for custody = fit for Community Service

28 28.11.1128 Community Service  CS Groups operate 4 – 5 days each week including weekends  Expect at least 5 hours work per week  Work around Offenders’ employment  Reparative but not therapeutic  Importance of Motivation  Less re-offending than prisoners

29 28.11.1129 Example that CS Works  Over 3000 hours have been worked in 2010 on ground maintenance, hedge planting and general improvement of our Jersey Rugby and Football Clubs.  We have evidence that some young offenders have re-engaged with these sports.

34 28.11.1134 Working with Offenders – General Presumptions  Low likelihood of re offending + low seriousness = no JPACS supervision  Low likelihood of re offending + custodial seriousness = Community Service  Medium or high likelihood of re offending = Probation supervision which can be coupled with CS (Caution)  Red Flag case – Risk of Harm / vulnerability procedures

36 28.11.1136 Jersey Skills Study  Video recording individual supervision interviews  100 sessions analysed by researchers at Swansea University scoring any core correctional practices  Results were cross checked against the Client’s LSI-R scores and reconviction information.
