ESPON Internal Seminar ARTS – Assessment of Regional and Territorial Sensitivity Liège, 17-18 November 2010

Content Main objectives The vulnerability concept Methodology The selected Directives

Main objectives presenting a new and fresh reflection on methodologies for assessing territorial and regional sensitivity of EU legislation, policies and directives (LPD) building a general common framework in which assessments concerning single different LPDs could fit; applying the proposed framework to around 12 EU directives building a more in depth assessment of 3 directives supplying policy makers with an operational procedure that could work as a “evidence based policy support” in the preparation of new legislation and directives; involving EU stakeholders (the Commission, national, regional and local authorities) and the ESPON MC in a dialogue

Vulnerability Concept Potential effects (exposure): Which economic, social, and environmental fields could be affected by EU directives? (Territorial) sensitivity: Which characteristics make a territory potentially affected in its economic, social, and environmental fields? Impact: Which are the territorial effects of a certain policy given its potential effects and regional sensitivities? Adaptive capacity: How weak/strong is the ability of a system to adjust to the potential impact? link to governance aspects Definitions in ARTS

Methodology Directive exposure matrix / Check list for potential effect, encompassing on the two dimensions: EU directives (12 selected directives), types of exposure Regional Exposure Filter assesses, if the Directives are relevant to each particular region Regional Sensitivity Filter, defines the sensitivity (low, moderate, high) of each region against the different types of exposure Territorial Impact Matrix, encompassing for each specific directive the types of exposure the sensitivity according to the regions

The Assessment Process Regional Sensitivity Filter Selected directives Types of exposures Region 1 Directive 1Directive 2 Directive n Regions Territorial Impact Matrix Regions Intensity of impacts Check list for potential effects Regional Exposure Filter Logical chains Region 2 Region n Directive 1 Directive 2 Directive n Regions Types of exposures Exposure 1 Exposure 2 Exposure n Selected directives Region 1 Region 2 Region n Region 1Region 2 Region n Types of exposures Exposure 1 Exposure 2 Exposure n Regional exposure Regional sensitivity (Logical Chains) (Regional Exposure to Directives) (Regional Sensitivity to Types of Exposure)

Types of potential impact Potential effects of a directive (qualitative magnitude) ++strong advantageous effect on territorial welfare +weak advantageous effect on territorial welfare Ono effect -weak disadvantageous effect on territorial welfare --strong disadvantageous effect on territorial welfare ?Unknown effect / effect cannot be specified +/-direction cannot be specified

Directive Exposure Matrix Deducing potential effects from Directives Input related sectors – pesticide production – spraying equipment Land use/types of territories –Natura 2000/FFH –special use of land (hospitals, parks, playgrounds) –strong protection Implementation process Socio-economic effects Agricultural production quantity Soil –„immission“ decreases –improvement of soil quality Air –aerial spraying prohibited –Improvement of air quality Water –efficient application techniques (no aerial spraying, no drift application) –Improvement of water quality Quality of LifeHuman Health Recreational value of land National Action Plan – Monitoring & Control Training Education/awareness Agricultural production quality Output related sectors – drinking water – fisheries – tourism Environmental effects Employment Innovation positive correlation Regulative framework Eco-system/ Bio-diversity Social effects negative correlation (sustainable use of) Pesticides Emission

Governance Aspects Analysis of sensitivity toward governance aspects Analysis of the adaptive capacity of the regions towards the potential impact of EU directives, depicting their vulnerability building a typology of governance elements and styles, that influence the implementation of EU directives In depth analysis for 3 test directives

Relevance Filter The selection of the Directives Eur-Lex Filter Title check Text check Number of directives Result of Eur- Lex filter Result of title check Result of text check 4396 directives 1393 directives 149 directives 28 directives

The selected Directives 1.Directive relating to limit values for sulphur dioxide, nitrogen dioxide and oxides of nitrogen, particulate matter and lead in ambient air 2.Directive establishing a framework for Community action in the field of water policy 3.Directive on the control of major-accident hazards involving dangerous substances 4.Directive relating to the assessment and management of environmental noise 5.Directive on the control of major-accident hazards - so-called Seveso II Directive 6.Directive on environmental liability with regard to the prevention and remedying of environmental damage 7.Directive on the interoperability of electronic road toll systems in the Community 8.Directive on the recognition of professional qualifications 9.Directive on the identification and designation of European critical infrastructures and the assessment of the need to improve their protection 10.Directive on the establishing a framework for Community action to achieve the sustainable use of pesticides 11.Directives on the promotion of clean and energy-efficient road transport vehicles 12.Directive on the energy performance of buildings
