In June 2002, the Ninth Circuit U.S. Court of Appeals ruled that the phrase “under God” was unconstitutional.

3. Scenario 2
On December 18, 1791, a 12-year old Philadelphia apprentice, Dillon, was arrested for burning down several stables containing hay and other goods. He was told by his minister, his boss and others to confess for the good of his “mortal body and soul” but he insisted he was innocent. Dillon continued to claim his innocence, but after he was kept in a dungeon for 2 days without heat, food, or water, he confessed. Dillon’s attorney said this confession was unreliable and illegal.

4. Scenario 3
A neighbor is suing the Smith’s because a tree in their yard fell on their roof during a hurricane. The neighbors want the Smith family to pay $850 to have their roof repaired. Mr. Smith decides to take this to court.

5. Scenario 4 Carolyn is arrested for shoplifting a candy
bar from a neighborhood convenience
store. At trial, she is found guilty. The judge decides that the appropriate punishment is to cut off Carolyn’s hands so that she will not be able to shoplift again.
Why can’t this be the punishment? (What amendment prohibits the judge from doing this?)

6. Scenario 5
Sixteen-year old Ryan is the captain of the football team. Before the Friday night game, he and his teammates are required to submit to a drug test. Ryan’s test shows traces of marijuana. He is not allowed to participate in the game and he is suspended from school.

Scenario 6
In 1930, eight black youths were sentenced to death in a hastily carried-out trial without a benefit of a lawyer.
What amendment does this violate?
Amendment 6- “counsel for defense” part of due process.
