2 What is Basel Convention? (1) It was created in 1989 to address concerns over the management, disposal and transboundary movement of hazardous wastes When it was revealed that HW was being indiscriminately disposed of in parts of Africa and East Europe, the international outrage led to the drafting of the Basel Convention 24 November 20152

3 What is Basel Convention? (2) - Aims to ensure that generation of hazardous and other wastes is reduced to a minimum - The availability of adequate disposal facilities for the environmentally sound management of hazardous and other wastes - That persons involved in the management of hazardous or other wastes take such steps as are necessary to prevent pollution due to hazardous and other wastes 24 November 20153

4 What is Basel Convention? (3) - To minimize the consequences of such pollution occurrence on human health and the environment - That the transboundary movement of hazardous and other wastes is reduced to the minimum consistent with the environmentally sound and efficient management of such wastes, and - Is conducted in a manner which will protect human health and the environment against the adverse effects which may result from such movement 24 November 20154

5 What is Basel Convention? (4) The Convention has two pillars: 24 November 20155 it obliges its parties to ensure that hazardous and other wastes are managed and disposed of in an environmentally sound manner it regulates the transboundary movement of hazardous and other wastes

7 Transboundary Movement “Transboundary movement” means any movement of hazardous wastes or other wastes from an area under the national jurisdiction of one State to or through an area under the national jurisdiction of another State or to or through an area not under the national jurisdiction of any State, provided at least two States are involved in the movement 24 November 20157

11 Important Points A Party shall not permit hazardous wastes or other wastes to be exported to a non-Party or to be imported from a non-Party 24 November 201511

12 Important Points Prohibit all persons under its national jurisdiction from transporting or disposing of hazardous wastes or other wastes unless such persons are authorized or allowed to perform such types of operations 24 November 201512

13 Important Points Require that hazardous wastes and other wastes that are to be the subject of a transboundary movement be packaged, labelled, and transported in accordance with generally accepted and recognised international rules 24 November 201513

14 Important Points Require that hazardous wastes and other wastes be accompanied by a manifest from the point at which a transboundary movement commences to the point of disposal 24 November 201514

15 Illegal Traffic without notification without the consent with consent obtained from States concerned through falsification, or fraud Each Party shall introduce appropriate national/domestic legislation to prevent and punish illegal traffic 24 November 201515
