1 2010 Fence Maintenance Plan October 28, 2009

2 It is time to paint the iron fences located in our community. Iron fences enclosing owner yards are owner responsibility, i.e., each owner must pay for painting of his/her iron fence. Board needs to ensure that all back yard fences are painted in 2010. If we don’t maintain fences they will rust and need replacement, resulting in higher costs to homeowners.

3 Maintenance of metal portions of fences enclosing an owner yard is a homeowner responsibility. (CC&R Article X, Section 3(b)) (p.155) Metal surfaces of all fences must be painted as needed to eliminate cracking, chipping and oxidation, and at least every two years. CC&R Article X, Section 4(e) (p.157)

4 Two Main Options: 1.Require each owner to paint their iron fence Problem: Each owner must select contractor. Problem: Lack of uniformity in color and quality of work 2.Association assumes responsibility for painting all iron fences and bills each owner for their share. Problem: Some owners may have already taken care of painting or want to do it themselves.

5 Board has arranged for all back yard fences to be painted in early 2010. High Quality Painting: [insert details] Includes all scraping, preparation, anti-oxidation coat, and finish coat in uniform color. Cost per square foot: $_____

6 Board of Directors to consider plan at a future meeting. Notice will be given to all homeowners. Board will hire a painter to measure each back yard iron fence. Each owner with iron yard fence will be billed in advance for painting work based on linear footage. Owners who do not wish to participate in the board organized painting may “opt out”. Opt out procedure will include inspection to ensure fence has been painted and no cracking, peeling or oxidation exists.

7 Why doesn’t the Homeowners Association pay for painting iron fences? The association has no authority to pay for this expense due to the CC&Rs. I have painted my iron fence within the last two years. What should I do? You may opt out of the program by giving written notice to the management company I want to paint my iron fence myself. Is that OK? Yes, you may paint your own fence. You will need to ensure that it is painted in the approved color. An anti- oxidant coat is highly recommended.

8 Who pays for painting of the HOA fences. The homeowners’ association will pay the cost of painting all common area fences. We have already begun this process.
