IssueResolutionIntervention 1. Interim payments to contractors Interim payments paid to contractors during projects construction phase are very low and are causing delays in completion of projects and sometimes lead to cancellations. Consultants handling projects will now be penalized if no support is provided to contractors during construction of projects. Contractors should be able to do proper cash flows. Contractors should be able to do measurement of quantity of work done because contractors are paid based on the quantity of work done. The above issues are covered in the mentorship programme. However currently mentorship is on hold. 2

IssueResolutionIntervention 2. Advertising of lower grade tenders There is a concern that some are advertised at a lower grade, but awarded to higher grade contractors. All tenders are advertised in accordance with CIDB best practices contractor grading designation. Advertisement are scrutinized and approved at BAC. 3. Down-grading of contractors Contractors are being down-graded on CIDB grading when they do not get tenders. The Department is aware of down- grading of contractors and discussions are underway with CIDB on this issue. 4. Transformation in the appointment of Project Managers The Department to look into appointing more African Project Managers. The Department of Public Works subscribes to Employment Equity and Affirmative action. These legislations are being implemented during the appointment of Project Managers. Interviews have already been held, awaiting the appointment of Project Managers. 3

IssueResolutionIntervention 5. Awarding of Tenders Same contractors are awarded with more that one tender at once. Currently there is no legislation that prohibits the awarding of more than one tender to one contractor. There is policy that guides the awarding of multiple contracts to a supplier/contractor on Provincial Treasury, Supply Chain Management Circular 3 of 2008. 6. Access to finance Financing of lower grade contractors Standard bank, ABSA and Ithala are available to assist all grades of contractors with access to finance. NURCHA is also available for tender amounts of the minimum R1 million. There is however a very low number of contractors that are accessing these initiatives. 4
