Protection of IP Copyrights are not a sufficient method of protection for software therefore it is necessary to have patents in order to ensure concrete protection of fraud. Patents are limited In order to receive a patent you must make a non obvious technical contribution. This, along with other rules, reduces the distribution of trivial patents. Also, if patents are found to be falsely granted, then they can be taken away. This means that development of new ideas is not going to be blocked by invalid patents. The Industry The strict intellectual property system in place in the United States is one of the reasons why our economy has been able to grow so quickly, creating new companies and jobs. Small start up companies are able to grow because their IP is protected by patents. This prevents major corporations, such as IBM, from coming in and stealing their ideas. Cost and Benefits Although it may be expensive to receive a patent now, the revenue acquired in the long run in many cases will far succeed that spent on obtaining the patent.
