2. 6 Major School Improvement Title I Regulation Changes 1)Section 200.37(b)(5)(ii)(B)  LEA must include information on the parental notification letter that SES providers are able to serve students with disabilities or LEP students 2) Section 200.39(c)(1)  LEA must prominently display required information regarding public school choice and supplemental educational services (SES) on its Website in a timely manner to ensure that parents have current information

3. 6 Major School Improvement Title I Regulation Changes - Continued The LEA must, in a timely manner, prominently display the following information on its website:  public school choice Beginning with data from the 2007-08 school year, and for each subsequent school year, the number of students who were eligible for and who participated in the public school choice option For the current school year, a list of available schools to which students eligible to participate in public school choice may transfer (PSC Guidance: D-8 & D-9)  supplemental educational services (SES) Beginning with data from the 2007-08 school year, and for each subsequent school year, the number of students who were eligible for and who participated in SES For the current school year, a list of SES providers approved by the State to serve the LEA and locations where services are provided (SES Guidance: G-10 & G-11) (c)(2) requires an SEA to post on its website the required information for any LEA that does not have its own Website (PSC Guidance: L-3; SES Guidance: B-9)

4. 6 Major School Improvement Title I Regulation Changes - Continued 3)Section 200.43 (two changes)  If a school begins to implement a restructuring option as a corrective action, the school does not have to implement a significantly more rigorous and comprehensive reform once the school reaches the restructuring improvement stage  A major restructuring of a school’s governance may include replacing the principal provided the change is part of a broader reform effort (must follow state personnel evaluation law) 4)Section 200.44 (a)(2)  An LEA must notify parents at least 14 calendar days prior to the first day of the school year the option for parents to transfer their child so that the child may transfer in the school year following the school year in which the LEA administered the assessments that resulted in its identification of the school for improvement, corrective action, or restructuring. (PSC Guidance: B-1)

5. 6 Major School Improvement Title I Regulation Changes - Continued 5) Section 200.47  SEA must: post on its Website each LEAs: 1) 20% setaside amount that LEA must spend on choice-related transportation and SES; and 2) the county maximum per-pupil allocation (PSC Guidance: L-2; SES Guidance: B-8)  Include on the SES state list providers who are able to serve students with disabilities or LEP students (SES Guidance: B1) 6) Section 200.48  An LEA that wishes to use unspent choice-related transportation and SES funds must: Maintain documentation demonstrating that the LEA has met the criteria; Notify the SEA that is has me the criteria and that it intends to spend the reminder of its 20% obligation on other allowable activities; and Specify the reminder amount.

6. 6 Major School Improvement Title I Regulation Changes - Continued Section 200.48 - continued  Requires SEAs to ensure an LEAs compliance through the regular monitoring process  In addition, for any LEA that The SEA determines has: spent a significant portion of its 20% obligation for other allowable activities; and been the subject of multiple complaints regarding the implementation of school choice or SES requirements... Must review the LEA’s compliance with the criteria by the beginning of the next school year (PSC & SES Guidance: Section K)  If the SEA finds that the LEA has failed to meet any of the 20% obligation criteria for school choice or SES, the LEA must: spend an amount equal to the remainder in the subsequent year, in addition to its 20% obligation for that year; OR meet the criteria and obtain permission from the SEA before using any unspent funds for other allowable activities in the subsequent year.

8. 6 Major School Improvement Title I Regulation Changes - Continued Section 200.48 – continued  Paragraph (d)(2)(i)(B)(3) requires an LEA to provide a minimum of two enrollment “windows” at separate points in the school year, that are of sufficient length to enable parents of eligible students to make informed decisions regarding requesting supplemental educational services and selecting a provider.
