Canadian Copyright As stated in the Copyright Act, copyright is: “ the sole right to produce or reproduce the work or any substantial part thereof in any material form whatever, to perform the work or any substantial part thereof in public or, if the work is unpublished, to publish the work or any substantial part thereof. ” Copyright Act, R.S. 1985, c. C-42, s. 3(1)

Fair Dealing There are certain circumstances in which a teacher or student can make use of a copyrighted work without infringing on it ’ s copyright. The Copyright Acts outlines a set of fair dealings. Copyright Act, R.S. 1985, c. C-42, s. 29(1-2)

The Purpose of the Dealing A person can make use of a work for research or private study, criticism or review, and news reporting. The Amount of the Dealing Did you need to use the amount that you did? Effect of the Dealing on the Work Will your use of the work effect the copyright owner ’ s ability to make money?

Question How long does copyright last? ?

Public Domain A work that is in the public domain is not copyright protected. This means that you do not need permission to use the work. Facts, ideas and news are in the public domain. If copyright protection has expired, then a work moves to the public domain (usually 50 years after the death of the author)

What if you wanted others to build upon your work or create something new from your original? You could give permission to each and every person that they may use your original.
