What are Civil Rights? “Civil rights" are the rights of individuals to receive equal treatment (and to be free from unfair treatment or "discrimination") in a number of settings -- including education, employment, housing, federal child nutrition programs and more -- and based on certain legally-protected characteristics. What is Discrimination? Discrimination is defined as different treatment which makes a distinction of one person or a group of persons either intentionally by neglect or by action or lack of actions based on any persons or group who has characteristics for which discrimination is prohibited based on the law, regulation, or executive order. LEP describes individuals who do not speak English as their primary language and who have a limited ability to read, speak, write, or understand English. USDA recognizes that faith based organizations have been a longstanding partner in supporting low income persons. There should be no barriers to participation in child nutrition programs for faith based communities. Faith based organizations are allowed to carry out their mission while participating in the program, as long as program funds to not directly support any inherently religious activities. Faith based organizations can use their own space for program participation without removal of any religious symbol or scriptures "USDA is an equal opportunity provider and employer."

Americans with Disabilities Act – prohibits discrimination based on a disability in all services, programs, and activities provided to the public by State and local governments, except public transportation services. All sponsors participating in Child Nutrition Programs are required to provide food substitutions or modifications for disabilities if: 1. A physicians statement is on file that describes the participant’s disability (a disability as defined in federal regulations) that prevents the participant from eating the regularly offered foods, and… 2. The physician has indicated the substitutions or modifications that the participant needs The Medical Statement from the licensed physician must be kept on file at the sponsor office/school "USDA is an equal opportunity provider and employer."

Data Collection Collection 1: Maintain in CNIPS the number ( do not use percentages ) of potential eligible beneficiaries by ethnic/racial category for the area served by the provider/district. Resolving Noncompliance Noncompliance is a factual finding that any civil rights requirement, as provided by law, regulation, policy, instruction or guidelines, is not being adhered to by a sponsor or its SFSP Sites. Noncompliance may be the result of: A review of civil rights compliance during routine reviews A special review or An investigation Once noncompliance is determined, steps must be taken to immediately obtain voluntary compliance Continued noncompliance may lead to suspension or final termination "USDA is an equal opportunity provider and employer."

Complaints must be processed within established timelines. Any person or representative has 180 days from the time of the alleged discriminatory act to file a complaint. A complaint form has been developed by the state agency to document details about the complaint, NOT as a prerequisite for filing a complaint. All complaints will be processed. 90 days is the maximum amount of time for KDE/FNS to process a compliant. "USDA is an equal opportunity provider and employer."

Remember to be conscious to treat all participants and parents/guardians with dignity and respect. Also ensure that Each participant receives the same menu items in the same amounts ( Disclaimer: Toddlers may be served a smaller portion. Teens may be served a larger portion.)
