Federal and NYS laws affecting workers under 18

Fair Labor Standards Act (FLSA) Restricts the hours that children under the age of 16 can work Forbids the employment of children under the age of 18 in certain jobs deemed to dangerous

FLSA (Cont.) For children working in agricultural operations, such as a family farm, it prohibits the employment of children under the age of 16 to work during school hours and in certain conditions deemed too dangerous

New York State Set Standards Each state has different standards they have to follow relating the hours a child can work. Under 16- day= 3-18 hrs night= work until 7pm during school and till 9pm durring summer 16and17- day= 4 before schoolday, 8 Friday, satuday, Sunday or holiday-28, if enrolled in school Night=10pm( midnight before school days with written permission from parents and school and before non-school day with parental consent) to 6am, while school is in session. Midnight to 6am while school is not in session.

Working papers Anyone under the age of 18 must show an employment certificate before they may begin working.

Blue Paper 14 and 15 years old Can’t work in factory workrooms or construction Can’t use machinery or chemicals Can’t work as a helper on a motor vehicle Can’t clean, oil, wipe, or adjust belts to machinery

Green Paper 16 and 17 ( who attend school) Valid for working in a factory and other trade, business or service Can’t- operate certain machines do construction work help on a motor vehicle clean, oil, wipe, or adjust belts to machinery

Salmon Paper 16 and 17 (full time) Valid for factory or other types of work Can’t- operate certain machines do construction work help on a motor vehicle clean, oil, wipe, or adjust belts to machinery

Restrictions (misc) Under 16 cant cook except at soda fountains, lunch counters, snack bars, and cafeteria serving counters Younger than 18 can’t operate, set up, adjust, clean, oil, or repair power driven equipment such as meat slicers or bakery mixers Under 18 can’t operate forklifts Under 16 can’t load or unload goods on or off trucks, railcars, or conveyors
