7. Preference Criterion A the good is wholly obtained or produced entirely in the territory of one or more of the parties Most often applies to raw materials, live animals, etc. It is uncommon to have industrial goods qualify under this

7. Preference Criterion B Goods containing non- originating materials that meet the Annex 401 origin rules: A change in tariff classification Regional Value Content (RVC) Both a change in tariff classification and a RVC requirement

7. Preference Criterion C Goods produced in the NAFTA region exclusively from originating materials Goods do not meet the definition of “wholly produced or obtained” but meet the “exclusively from originating” requirement Special rules apply to agricultural goods

7. Preference Criterion D Unassembled goods and goods classified with their parts which do not meet the Annex 401 rules of origin, but contain sufficient RVC Rule D does not apply to textile articles of Chapters 61 –63 and is limited to the following scenarios: The good was imported into the territory in unassembled or disassembled form, but was classified as an assembled good under the HS system Parts and final products are classified under the same heading or subheading as long as the description of the heading or subheading provides for and clearly describes both the good itself and its parts, and is not further subdivided

7. Preference Criterion E Certain automatic data processing goods and their parts that do not originate in the territory are considered originating upon importation into another NAFAT country when the MFN duty rate matches the rate listed in Annex 308.1 and is common to all NAFTA countries

7. Preference Criterion F The agricultural good is originating under preference criterion A, B, or C and is not subject to a quantitative restriction in the importing NAFTA country because it is a “qualifying good” as defined in Annex 703.2, Section A or B
