2 2015 Legislation SB15-213 – “Claire Davis Act” - “Concerning the Limited Waiver of Governmental Immunity for Claims Involving Public Schools for Injuries Resulting from Incidents of School Violence.” “Reasonable care” to protect students, faculty, staff and others from harm that is reasonably foreseeable Waives “sovereign immunity” in connection with claims against public school districts and charter schools in action for serious bodily injury or death resulting from an incident of school violence (including sexual assault) “an employee of a public school, school district, or a charter school is not subject to suit under this section in his or her individual capacity unless the employee’s actions or omissions are willful and wanton.”

3 2015 Legislation SB15-214 – “Concerning Creating a legislative Committee on Safety in Schools, and, in Connection therewith, Making an Appropriation” Creates a School Safety & Youth Mental Health Committee Studying issues relating to school safety and the prevention of threats to the safety of students, teachers, administrator, employees and volunteers. Make recommendations concerning steps that a school district or charter school may take to satisfy its duty of reasonable care May recommend legislative changes 8 Legislators will be the voting members

4 Components of the Colorado Safe Schools Act C.R.S. 22-32-109.1 Makes safety a priority in mission Development of a safe schools plan Requires written policies for conduct and discipline codes Bullying prevention & education Safe schools reporting requirements for conduct & discipline code violations Internet safety plan Child sexual abuse prevention plan Agreements with state agencies School response framework- school safety, readiness & incident management plan Safety & security policy Employee screenings Immunity for school personnel- safe school plan Compliance with reporting Sharing information
