Patent Landscape Reports Project Review Geneva 12 November 2012 Irene Kitsara Patent Information Section, Access to Knowledge and Information Division

Outline Project Background Patent Landscape Reports Definition, components, possible content, uses and beneficiaries Phase I review Cooperation established Reports prepared Usefulness of the reports Phase II – way forward

Project Background Development Agenda – Recommendations 19, 30 and 31 (CDIP/4/6) “Developing Tools for Access to Patent Information” Implementation started in early 2010 Expected output: Preparation of Patent Landscape Reports in identified key areas of interest for DCs: Public Health Food and Agriculture Energy and Climate Change

What is a patent landscape report? Research and analysis of patenting activity and innovation trends in a specific technological field/geographical area using patent information Transformation of raw patent data through patent search (patent databases) into comprehensive patent analysis (breakdown and analysis of the results, visualization, conclusions) Useful support tools for policy-makers in public and private sector Raw data Patent Search Patent analysis

Patent Landscapes - Components Background information - definition of the technical problem Patent search - State of the art search (prior art) on patent database(s) with detailed description of methodology Statistical analysis and visualization Interpretation/evaluation/recommendations (possibly with correlation with non-patent data)

Examples of patent analysis options and use of Patent Landscapes

7 What can a Patent Landscape show? General innovation/technology trends  identification of promising areas of technology Source: PATENTSCOPE® Search Service

What can a Patent Landscape show? Trends in technological (sub)sectors over time  comparison of trends in subsectors in comparison to broader fields Source: WIPO Landscape Report on Desalination

What can a Patent Landscape show? Break down of the results by subtechnologies/components  trends, promising or overdeveloped areas Source: WIPO PLR on Solar Cooking Components of indirect heating method technology

What can a landscape report show? Top patent applicants/key players in an area of technology  potential collaboration partners, licensing, technology/know how transfer etc Source: WIPO PLR on Membrane Filtration and UV Water Treatment

What can a Landscape Report show? Geographical distribution of sought patent protection Potential Market analysis, areas of public domain etc. Office(s) of second filing (OSF) - top 30 applicants Source: WIPO PLR on Vaccines for Selected Diseases

What can a Patent Landscape show? Applicant-inventor network and collaborations  which linkages exist between key inventors and applicants?  potential cooperation partners (joint research, technology/know-how transfer, licensing etc.) Source: WIPO Desalination Patent Landscape Report

What can a Patent Landscape show? Innovation tracks - patent generations based on citation analysis  development in the scope and duration of patent protection Source: WIPO PLR on Ritonavir

What can a Patent Landscape show? Correlation of patent data with non-patent data  better overview of the area of technology, the relevant market and its dynamics Source: IEA, Energy Technology R&D Statistics 2007 Correlation between R&D investment and patenting activity

Uses and beneficiaries of PLR Support tool for decisions related to: Innovation policy and investment R&D prioritization and investment Technology and know-how transfer Collaborations Patent portfolio management Technologies in the public domain Potential beneficiaries: Policy makers (governments etc) R&D institutes Academia SMEs

PLR Project review: How it works Request from a WIPO Member State or an IGO/NGO (topic of interest for DCs) Development of Terms of Reference (methodology, specific questions to be addressed, types of analysis etc) Public procurement procedure  evaluation of offers  contracting Review of various contractor’s deliverables by WIPO with collaboration partner, refinement of questions etc. Publication of PLR Evaluation of the usefulness and usability of the reports to the cooperation partner and to further users of the report

Phase I Review Established network and collaboration with IGOs and NGOs with expertise in the subject matter and focus of work in developing countries Identification of topics and preparation of 9 patent landscape reports Development of methodology for preparation of reports (ToR, public procurement etc) Detailed description of various patent search methodological approaches (educational role of reports) Delivery of useful reports (external evaluation report and feedback from cooperation partners and other users – survey)

WIPO PLR collaborations and outputs Public Health: WHO  Vaccines for selected diseases Medicines Patent Pool  Ritonavir  Atazanavir DNDi  Selected Neglected Diseases Climate Change and Energy: IRENA / GIWEH  Desalination and Use of Renewable Energy (1 st time that WIPO active in the area of water) GIWEH  Membrane Filtration and UV water treatment Other PLR in the area:  Solar cooking  Solar cooling

WIPO and Cooperation in identified subject matters Food and Agriculture: FAO, ISF, AATF  Plant salinity tolerance (PGRFA) Projects on the pipeline: FAO, AATF  Plant drought tolerance FAO  animal Genetic Resources (FAO Conference on Biodiversity 2013) UNEP  e-waste recycling and material recovery (Basel Convention)

Use of prepared WIPO PLR reports by cooperation partners WHO  evidence for technology transfer discussions in the area of vaccines Medicines Patent Pool  data supporting medicines procurement in developing countries IRENA  mapping of the patenting activity in the area of desalination using renewable energies and better awareness for technology transfer discussions

WIPO´s dedicated website to PLR www.wipo.int/patentscope/en/programs/patent_landscapes/index.html

a. Compilation of published PLR

b. On-going work at WIPO

Phase II of the PLR project CDIP 10/13 Evaluation report Project document with a Phase II proposal Phase II vision: Use of existing experience, methodology, infrastructure and network from Phase I of the project Further preparation of 7 reports in areas of interest for developing countries during Phase I of the project Regional conference - discussion of landscaping options, challenges and best practices

Phase II – Way forward Phase II vision: Differentiated approach to optimize needs assessment, results, implementation of the results and increased impact (closer discussion with national actors, governments and institutions) Way forward: Mainstreaming of the patent landscaping service as a regular WIPO activity
