Your partner for a stronger Arizona Defining “Parent” If the biological or adoptive parent is not available, the parent is determined in order of availability: Relative or stepparent with whom the child lives A foster parent A guardian appointed for the child (cannot be an employee of DES or any State agency) A surrogate parent

Your partner for a stronger Arizona What’s New (Surrogate Parent) Must be assigned within 30 days of determination after reasonable efforts to locate the parent have been made NEW May be assigned by judge overseeing the child’s case NEW May not be an employee of a public agency that provides education or care to a child REVISION Family member may not be assigned as a “surrogate parent” REVISION
