3 3 OVERVIEW This presentation provides an account of overall performance of the Commission for the financial year 2014/2015. The Commission welcomes the unqualified audit opinion received. There are areas of improvement identified around SCM and compliance related to regulations thereto and actions are being implemented to ensure compliance. There has been an increase in overall performance for the reporting period, to annual targets that were set in the Annual Performance Plan lodged with this House. For the reporting period, 88% of the predetermined objectives has been achieved. There are areas (14%) where the Commission struggled which impeded getting the 100% mark. It should be noted that out of the 14%, work has been done, but the objective was partially achieved.

5 5 CONSTITUTIONAL MANDATE The Constitution of SA created an independent Commission for Gender Equality to deal specifically with promotion of gender equality and to advise and make recommendations relating to gender equality and status of women. Section 181 read with section 187 of the Constitution establishes the Commission for Gender Equality. In terms of section 187 CGE must promote respect for gender equality and the protection, development and attainment of gender equality

10 10 Heading Text/Content STRATEGIC OBJECTIVE 1: To ensure the creation and implementation of an enabling legislative framework that promotes the attainment of gender equality To monitor equality and evaluate the promotion of gender equality and relevant policies and practices of the public and private sector and report parliament To initiate and/or participate in the review of the legislative framework in all spheres of government that impact on gender equality To conduct performance assessments of political parties and the public and private sectors on the effective implementation of gender equality legislation policies and practices To evaluate the implementation and effectiveness of national justice facilities in addressing gender discrimination To convene policy dialogues with relevant policy makers at national and provincial level on recommendation s to promote gender equality contained in research reports and research activities

11 11 Heading Text/Content STRATEGIC OBJECTIVE 2: To protect and promote gender equality by engaging with relevant stakeholders to educate and raise awareness on issues of gender equality challenge patriarchal perceptions and stereotypes and take action against infringements of gender rights through the implementation of appropriate redress To timeously investigate complaints of violations of gender rights and identify appropriate re­ dress Initiate an investigation into systemic violations of gender rights and identify remedial action. To develop co- ordinated programme to promote gender equality To initiate interventions for the sustainable development and promotion of gender equality by addressing violations in the social cultural political economic security and human rights dimensions To collaborate with organs of state civil society and other institutions for the effective development protection promotion and attainment of gender equality

12 12 Heading Text/Content STRATEGIC OBJECTIVE 3: To monitor state compliance with regional and international conventions covenants and charters which have been acceded to or ratified by the Republic relating to the object of the Commission for Gender Equality. To conduct annual reviews and audits of state compliance with obligations under the conventions covenants and charters and to report on a regular basis to Parliament and the Office of the Speaker of Parliament To interact with and present reports to national regional and international bodies on state compliance with conventions covenants and charters acceded to or ratified make recommendations for improvements and monitor implementation

13 13 Heading Text/Content STRATEGIC OBJECTIVE 4: To build an effective efficient and sustainable institution that will fulfil its constitutional mandate on gender equality To maintain optimal governance and oversight structures and policies between Commissioners and the Secretariat To maintain the financial management strategy so that it promotes effective efficient and economic utilisation of resources as well as accountability To develop and maintain an IT infrastructure that supports and promotes the organisational objectives of the CGE To develop and implement comprehensive HR policies procedures and practices Review the communications strategy and policy that promotes and enhances a positive public image of the CGE

14 14 Performance Overview – SO1  Consultations on implementation on the findings of previous EE Hearings;  Gender Transformation Hearings with UNISA, UNIVEN and Dept of Higher Education;  Finalise Gender Barometer report;  23 Submissions made for Legislative and Policy enhancement for the gender equality framework;  1 assessment report on Gender & Elections;  Assessment of the effective functioning of the GBV Council;  Court Monitoring report;  18 Policy Dialogues conducted on research studies on previous financial year.

15 15 Text/Content ActivitiesFindings / Issues Consultations on implementation on the findings of previous EE Hearings The entities are implementing recommendations. There is good progress. Gender Transformation Hearings with UNISA, UNIVEN and Dept of Higher Education DHET and UNISAs policies were implemented. There is room for improvement. UNIVEN’s policies are lacking and further engagements have been recommended to assist. Finalise Gender Barometer report Focus was on COGTA (national), Depts of Sports, Arts, Culture & Recreation (Provincial). Significant progress are made by Government Departments in relation to women in decision making. 1 assessment report on Gender & Elections There has been a decline in women’s representation in National Assembly after 2014 election. 43% to 39,7%. There is not adherence to SADC Protocol on Gender and Development.

16 16 Heading Text/Content ActivitiesFindings / Issues Assessment of the effective functioning of the GBV Council Council has collapsed due to lack of accountability and political will. There is a lack of coherence of strategies to coordinate activities geared towards addressing GBV in the country. Court Monitoring report Sexual Offences – found that not all magistrate courts have sexual offences courts, Minimal training of staff, DNA backlog contribute to delay in finalising cases. Maintenance Courts – Services at courts very poor, staff shortages. Equality Courts – Courts were not functional. Domestic Violence – Need for training on Domestic Violence Act, understaffed.

18 18 Heading Text/Content ActivitiesKey findings / issues National Gender Summit Report was tabled and findings and recommendations have been shared. Women’s Month Campaign Focussed on maternal and reproductive health. Level of Maternal Health and anti-natal care very low. Teenage pregnancy is rife. Abortion clinic is not accredited and result in complications. HIV positive women experience challenges during pregnancy including forced sterilisation. 16 days of activism Access to maintenance remains a challenge. Poverty forces young girls into transactional sex and human trafficking. Femicide cases increased.

19 19 Heading Text/Content ActivitiesKey findings Traditional Leadership and religious sector In some provinces traditional leaders are reluctant to engage on cultural practices that impact on gender equality. Many faith based organisations are not keen to address issues of sexuality and sexual orientation. Systemic Investigations Sex work, JSC and Maternal Health are still under investigation.

A number of topics were discussed, namely, Gender talks focusing on challenges facing South Africa in relation to achieving gender equality Women in leadership and decision making during women’s month Femicide also known as intimate partner killings during 16 days of activism campaign Know your rights during human rights month focusing in equality, gender equality, gender discrimination and the Bill of rights

33 33 Conclusion The Commission has carried out and achieved the objectives as set out in the APP. Overall there are recognisable efforts to reach the goal of gender equality, however steady advances towards gender transformation is still strewn with intractable and insurmountable drawbacks, with high levels of GBV, brutality towards women and members of LGBTI community. We still further wish to see 50/50 representation being realised in all political parties as we embark on a journey towards local government elections in 2016.
