CREATION OF THE UTAH PUBLIC SERVICE COMMISSION 1917-created by legislation and named the Public Utilities Commission Purpose: To assure the growth and development of the recently formed utility companies and the industry according to sound economic principles

THE UTAH PSC TODAY Today-the PSC is an independent state agency with it’s own budget and staff Role of PSC-To assure safe, reliable, adequate, and reasonably priced utility services Jurisdiction-Electricity, natural gas, telecommunications and small independent water companies

Budget Annual budget-$1,642,900 Source of funding-Public Utility Regulatory Fee (.03% of annual revenues of the electric utility)

ADMINISTRATIVE PROCEEDINGS Quasi-judicial with commissioners sitting as finders of fact and law Cases (called dockets) commenced by the filing by a party or by the PSC Discovery is taken in the form of “Data Requests”, much like in judicial proceedings

Administrative Proceedings (cont.) Testimony is taken under oath with opportunity for rebuttal and cross- examination Hearings are recorded by a court reporter and transcribed upon request Formal testimony is pre-filed in writing or electronically Parties are usually represented by attorneys

Administrative Proceedings (cont.) Decisions, in the form of an “Order” are issued by the PSC PSC decisions may be appealed to the Utah Supreme Court
