9 Tinker v. Des Moines (1969) In December 1965 three public school students wore black armbands to school to protest the Vietnam War. The students were John Tinker (15 years old), Mary Beth Tinker (13), and Christopher Eckhardt (16). School leaders knew that the protest was planned and stated that wearing an armband would result in suspension from school. The students refused to remove their armbands and were suspended. The Tinkers filed a lawsuit over the armband policy that went all the way to the Supreme Court.
